Ordinance No. 9,472ORDINANCE NO. 9472 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN AMENDING THE CITY OF BAYTOWN PERSONNEL POLICY MANUAL TO ALLOW A PERFORMANCE EVALUATION TO BE CONDUCTED ON THE EMPLOYEE'S ANNIVERSARY DATE; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Chapter 5, " Perfonnance Evaluations of the City of Baytown Personnel Policy Manual is hereby amended to read as follows: CHAPTER 5 PERFORMANCE EVALUATIONS Section 1. Performance Evaluation Report The work performance of each full -time employee shall be evaluated in accordance with the performance evaluation system developed by the Director of Human Resources. The performance evaluation system will be used as a management tool to communicate to the employee his or her work performance. It will be utilized to improve communication between the supervisor and employee, improve performance problems, reward employees, identify training and development needs, and to assist in promotions. All full -time employees will be evaluated on their anniversary date commencing on October 1, 2002. Full -time employees on probation will receive their first performance evaluation at six (6) months and then yearly thereafter on their anniversary. Every full -time employee will be evaluated during the month that his or her anniversary date falls. If a merit raise is warranted, it will be effective on the employee's anniversary date. The amount of salary increase, if any, will be based on the current budget and the compensation plan approved by City Council. The anniversary date will be the date of hire. The only exception to this is for full -time employees that have been promoted, demoted or laterally transferred. Once an employee has been promoted, demoted or laterally transferred, the employee's raise date changes to the date of such action. The Department Director may extend an employee's probation. It is the responsibility of the Department Director to document this action in writing and forward it to the Human Resources Department. The probationary period may be extended to allow the employee further time to improve his or her}ob performance. No employee will be taken off probation until he or she is performing at a fully satisfactory level or better. If an employee is absent during the year for an extended period of time, the review may be delayed until sufficient time has passed in which to evaluate the employee's performance. Section 2. Performance Evaluation Report for Part -time Employees Part-time employees will be evaluated on their anniversary dates commencing on October 1, 2002. After completing two (2) years of service, part-time employees are eligible for merit increases every two years. The amount of merit increase, if any, will be based on the current budget and the compensation plan approved by City Council. Seasonal part-time employees are not eligible to participate in the merit plan. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
