ORDINANCE NO. 9441 18, 2002, in The Baytown Sun.
• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
ADDING A 6 -ACRE TRACT EAST OF THOMPSON ROAD AND SOUTH OF
INTERSTATE 10 AND THE ATLANTIS TRUCK WASH PROPERTY, IN THE
WILLIAM HILBUS SURVEY, ABSTRACT 336 TO COUNCIL DISTRICT NO. 3;
REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS
CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE
THEREOF.
WHEREAS, Section 17(1) of the Charter of the City of Baytown provides that the City Council shall
redistrict the City if the growth of the City justifies; and
WHEREAS, it is necessary to include the newly annexed territory described herein in a Council
District; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: Council District No. 3 is hereby redistricted by the addition of certain property which
is described on the attached Exhibit "A."
Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are
hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject
matter covered by this ordinance.
Section 3: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase
of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held
unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this
ordinance or their application to other persons or sets of circumstances and to this end all provisions of this
ordinance are declared to be severable,
Section 4: This ordinance shall take effect from and after ten (10) days from its passage by the
City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance
to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after
passage of this ordinance.

bounds as follows:
FIELD NOTES of a 6.00 acre tract of land situated in the William Hilbus Survey, Abstract 336, Harris
County, Texas. Said 6.00 acres being out of and a part of that certain 6.00 acre tract of land conveyed by
Floyd D. Woods to Charles W. Caldwell, et ux, by Deed dated July 10, 1996 and recorded in County
Clerk's File No. SO 15995 of the Official Public Records of Real Property of Harris County, Texas and out
of and a part of that certain 6.00 acre tract of land conveyed by Floyd D. Woods to Sterling Trust Company
by Deed dated July 10, 1996 and recorded in County Clerk's File No. SO 15998 of the Official Public
Records of Real Property of Harris County, Texas. This 6.00 acre tract is more particularly described by
the following metes and bounds, to -wit:
NOTE: BEARINGS ARE BASED ON DEED BEARINGS AND FOUND MONUMENTS IN THE
NORTH LINE OF SAID 6.00 ACRE TRACT. REFERENCE IS MADE TO THE PLAT OF EVEN
DATE ACCOMPANYING THIS METES AND BOUNDS DESCRIPTION.
BEGINNING at a'' /2 inch iron rod found in the East right -of -way line of Thompson Road (60 feet wide
right -of -way) at the Southwest corner of that certain 10.00 acre tract of land conveyed by Floyd D. Woods
to Mohammad A. Subedar and Shabana Subedar by Deed dated March 4, 1999 and recorded in County ,
Clerk's File No. T584957 of the Official Public Records of Real Property of Harris County, Texas and the
Northwest cot atr of said 6,00 acres conveyed to Caldwell- Said point being the Northwest corner and
POINT OF BEGINNING of this tract; from which a '/: inch iron rod found for the Northwest comer of said
10.00 acres bears North 02 deg. 40 min. 38 sec. West 408.06 feet
THENCE: North 86 deg. 53 min. 46 sec. East along the North line of this tract, the North line of said 6.00
acres conveyed to Caldwell, the North line of said 6.00 acres conveyed to Sterling Trust Company and the
South line of said 10.00 acres and at 556.91 feet pass a' /2 inch iron rod found for the Northeast comer of
said 6.00 acres conveyed to Caldwell and the Northwest comer of said 6.00 acre tract conveyed to Sterling
Trust Company, in all, a total distance of 1089.66 feet to a'/2 inch iron rod found in the West right -of -way
of the San Jacinto River Authority Canal Tract as described in Volume 1273 at Page 467 of the Deed
Records of Harris County, Texas, for the Southeast comer of said 10.00 acres, the Northeast corner of said
6.00 acres conveyed to Sterling Trust Company and the Northeast comer of this tract.
THENCE: South 08 deg. 53 min. 46 sec. East along the East line of this tract, the East line of said 6.00
acres conveyed to Sterling Trust Company and the West line of said San Jacinto River Authority Canal
Tract for a distance of 23816 feet to a' /2 inch iron rod, with cap, set for the Southeast comer of this tract
THENCE: South 86 deg. 53 rain. 46-sec. West along the South line of this tract, over and across said 6.00
acres conveyed to Sterling Trust Company and over and across said 6.00 acres conveyed to Caldwell for a
distance of 1115.47 feet to a ''A inch iron rod, with cap, set in the East right -of -way line of said Thompson
Road and the West line of said 6.00 acres conveyed to Caldwell, for the Southwest comer of this tract.
THENCE: North 02 deg. 40 min. 38 sec. West along the West line of this tract, the West line of said 6.00
acres conveyed to Caldwell and the East right -of -way line of said Thompson Road for a distance of 237.05
feet to the PLACE OF BEGINNING and containing within these boundaries 6.00 acres of land.

Baytown; and is vacant and without residents or on which fewer than three qualified
voters reside.
