The City Council of the City of Baytown, Texas, met in a Regular Meeting on Thursday, March
12, 2020, at 6:31P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street,
Baytown, Texas with the following in attendance:

Mayor Capetillo convened the March 12, 2020, City Council Regular Meeting with a quorum
present at 6:31 P.M., all members were present.
Pledge of Allegiance, Texas Pledge, and Invocation was led by Council Member Presley.
1. MINUTES
a. Consider approving the minutes of the City Council Special Meeting, Retreat, Day
1, held on January 10, 2020.
A motion was made by Council Member Hoskins and seconded by Council Member Alvarado
approving the January 10, 2020, City Council, Day 1 Retreat, Special Meeting minutes. The vote
was as follows:

a. Consider a resolution accepting a donation from Exxon Mobil Corporation in
support of the City of Baytown Fire Department.
Fire Chief, Kenneth Dobson presented the agenda item and stated that Resolution No. 2636
accepts a donation from Exxon Mobil Corporation in the amount of $5,000 to support the City of
Baytown Fire Department.
A motion was made by Council Member Alvarado and seconded by Council Member
Betancourth approving Resolution No. 2636, regarding agenda item 2.a. The vote was as

3. PROPOSED ANNEXATION OF APPROXIMATELY 4.86 ACRES OF LAND
a. Conduct a second public hearing regarding the proposed annexation of
approximately 4.86 acres, located approximately 285 feet west of West Road and 670 feet
north of West Cedar Bayou Lynchburg Road and situated in the Ed. T. Schaffer (W.C. &
R.R.) Survey, Abstract No. 1224, Harris County, Texas.
b. Consider an ordinance for the first reading of the proposed annexation of
approximately 4.86 acres, located approximately 285 feet west of West Road and 670 feet
north of West Cedar Bayou Lynchburg Road and situated in the Ed. T. Schaffer (W.C. &
R.R.) Survey, Abstract No. 1224, Harris County, Texas.
At 6:34 P.M., Mayor Capetillo opened and conducted a second public hearing regarding the
proposed annexation of JLC West Road LLC, approximate 4.86 acres located approximately 285
feet west of West Road and 670 feet north of West Cedar Bayou Lynchburg Road and situated in
the Ed. T. Schaffer (W.C. & R.R.) Survey, Abstract No. 1224, Harris County, Texas.
Director of Planning and Community Development, Tiffany Foster summarized agenda items
3.a. and 3.b. together as there were related. She stated that was a little less than five (5) acres of
triangular land located behind Lowes. She stated that agenda item 3.a. was the second public
hearing and agenda item 3.b. was the first reading for the annexation. Additionally, she stated
that following this item there would be a second reading and placement of the property into a
council district.
With there being no one registered to speak regarding agenda item 3.a., Mayor Capetillo closed
the second public hearing at 6:35 P.M.
A motion was made by Council Member Betancourth and seconded by Council Member Himsel
approving Ordinance No. 14,344, regarding agenda item 3.b. The vote was as follows:

a. Conduct second public hearing regarding the proposed annexation of
approximately 35.1 acres, located along the southern boundary of Hunt Road
approximately 2,040 feet west of North Main Street, addressed as 703 Hunt Road, and
situated in Ashbel Smith Survey, Abstract No. 1562, Harris County, Texas.
b. Consider an ordinance for the first reading of the proposed voluntary annexation of
approximately 35.1 acres, located along the southern boundary of Hunt Road
approximately 2,040 feet west of North Main Street, addressed as 703 Hunt Road, and
situated in Ashbel Smith Survey, Abstract No. 1562, Harris County, Texas.
At 6:36 P.M., Mayor Capetillo opened and conducted a second public hearing regarding the
proposed annexation of approximately 35.1 acres, located along the southern boundary of Hunt
Road approximately 2,040 feet west of North Main Street, addressed as 703 Hunt Road, and
situated in Ashbel Smith Survey, Abstract No. 1562, Hams County, Texas.
Mrs. Foster summarized agenda items 4.a. and 4.b. together and stated that the property was a
residual portion of land that was not annexed in the year 2012, in which there was a development
agreement that expired. Additionally, she stated that the property owner also requested a zoning
change through the Planning and Zoning Commission.
Mr. Dims Mandi registered to speak at the second public hearing regarding agenda item 4.a.
Mr. Mandi, 4100 Southwest Freeway, Houston, Texas, 77027, stated that he is the son of the
property owner and the owner requested that council approve the acquisition.
A motion was made by Council Member Betancourth and seconded by Council Member Hoskins

situated in the R.A. Porter Survey, Abstract 205 and the B.B.B. & C. Railroad Survey,
Abstract 61, Chambers County, Texas.
b. Consider an ordinance for the first reading of the proposed annexation of
approximately 63.57 acres, located along the northern boundary of FM 565 Road
approximately 1,000 feet east of FM 1405 Road, addressed as 1411 S. FM 565, and situated
in the R.A. Porter Survey, Abstract 205 and the B.B.B. & C. Railroad Survey, Abstract 61,
Chambers County, Texas.
At 6:38 P.M., Mayor Capetillo opened and conducted a second public hearing regarding
the petition, by Jindal Saw USA, LLC, for the proposed annexation of approximately 63.57
acres, located along the northern boundary of FM 565 Road approximately 1,000 feet east of FM
1405 Road, addressed as 1411 S. FM 565, and situated in the R.A. Porter Survey, Abstract 205
and the B.B.B. & C. Railroad Survey, Abstract 61, Chambers County, Texas.
Mrs. Foster summarized agenda items 5.a. and 5.b. together as they were related. She stated that
a portion of the property is currently in the city limits and has an operating business. She stated
that the portion of the property that abuts FM 565 is not in the city limits, in which the owner
seeks annexation as they are going through an expansion project, as well as, request a zoning
change through the Planning and Zoning Commission.
With there being no one registered to speak regarding agenda item 5.a., Mayor Capetillo closed
the second public hearing at 6:39 P.M.

6. PROPOSED ORDINANCES
a. Consider an ordinance authorizing a professional service agreement with
Kendig Keast Collaborative, LLC, for the Baytown 2040 Comprehensive Plan and Bayway
Drive Corridor Plan.
Mrs. Foster presented the agenda item and stated that Ordinance No. 14,347 authorizes a
professional service agreement with Kendig Keast Collaborative, LLC, for the Baytown 2040
Comprehensive Plan and Bayway Drive Corridor Plan in an amount not to exceed $302,200. She
stated that timeline for the Bayway plan was about six (6) months and approximately 15 months
for the comprehensive plan. Additionally, she relinquished time for a representative of Kendig
Keast Collaborative, LLC to provide more information regarding the plans.
Gary Mitchell, President Kendig Keast Collaborative (KKC), LLC, noted that he worked on the
City's Comprehensive Plan in the year 2000, as well as, the 2006 update. He stated with regards
to this agenda item that they would conduct a minimum of 8 stakeholder/public meetings,
provide a "meeting -in -a -box" for staff lead public engagement, and create a project website with
engagement activities, for the Baytown 2040 Comprehensive Plan. He stated that they would
first hold a joint workshop with Council and the Planning and Zoning Commission before
meeting with the public and then another workshop prior to the public hearings to review final
plans. He further noted that the Bayway Drive Corridor Plan would also include several
stakeholder/public meetings and web based engagement.
Mr. Mitchell stated that they build on city priorities; therefore, the Imagine Baytown process
would be the basis for the comprehensive plan and although there were stipulations surrounding

travel, there were items in the plan they could continue to work on during such time, prior to
doing public activities.

TEXAS; DIRECTING THE MAYOR TO NOTIFY THE FEDERAL AVIATION

TO THE U.S. DEPARTMENT OF HOMELAND SECURITY'S FEDERAL
EMERGENCY MANAGEMENT AGENCY FOR AN FY2019 ASSISTANCE
TO FIREFIGHTERS GRANT FOR THE PURCHASE OF A NEW CUSTOM
CAB TRACTOR DRAWN TRAILER IN THE AMOUNT OF ONE MILLION
AND NOI100 DOLLARS ($1,000,000.00); AUTHORIZING A CASH MATCH
IN AN AMOUNT NOT TO EXCEED ONE HUNDRED THOUSAND AND
NOI10o DOLLARS ($100,000.00); DESIGNATING AN AUTHORIZED

a. Confirm the City Manager's appointment of the City of Baytown Flounce Director.
A motion was made by Council Member Hoskins and seconded by Council Member Johnson
approving City Manager Davis's appointment of Victor Brownly as the City of Baytown Finance
Director. The vote was as follows:

Johnson, Council Member Betancourth, Council Member Hoskins,

9. MANAGER'S REPORT
a. The Fourth Annual Arts and Eats Fest (formerly known as the Food Truck Festival
and Sidewalk Art Contest) is scheduled for Saturday, March 21 from 4:00 P.M. to 8:00
P.M. at Town Square located at 213 West Texas Avenue.
Council Member Betancourth expressed appreciation from a victim's perspective to the Baytown
police department for providing great customer service while assisting her with the recovery of
delivery items stolen from her home.
Director of Parks and Recreation, Scott Johnson presented the agenda item and stated that the
Fourth Annual Arts and Eats Feat would be held on Saturday, March 21 from 4:00 to 8:00 P.M.
at Town Square. He stated that the event would include chalk art, food trucks, and local live
entertainment by Groove Adhesive, Goose Creek Memorial High School, Ross S. Sterling High
School, Robert E. Lee High School, and Lee College beginning at 4:00 P.M. He also noted that
there would be entertainment at the Brunson patio and at the Umbrella alley.
Additionally, City Manager Davis noted that there was daily contact and collaboration with state
and local officials regarding the COVID-19 pandemic. He stated that city hall operations were
not curtailed and there were no anticipation of suspending operations or services but there
possibly would be adjustments to programming as time moves forward for precautionary
measures. He further stated that he would provide updates as he received them.
