ORDINANCE NO. 9404
® AN ORDINANCE OF THE CITY COUNCIL, CITY OF BAYTOWN, TEXAS,
PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE
CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF A 6 -ACRE TRACT EAST
OF THOMPSON ROAD AND SOUTH OF INTERSTATE 10 AND THE ATLANTIS
TRUCK WASH PROPERTY, IN THE WILLIAM HILBUS SURVEY, ABSTRACT 336;
WHICH SAID TERRITORIES LIE ADJACENT TO AND ADJOIN THE PRESENT
BOUNDARY LIMITS FOR THE CITY OF BAYTOWN, TEXAS.
WHEREAS, there being no request for an "on- site" hearing, two public hearings before the City
Council of the City of Baytown, Texas, where all interested persons were provided with an opportunity to be
heard on the proposed annexation of the property described in Section 1 of this ordinance, were held, during
the City Council meeting on the 25`' day of July, 2002, at 6:30 p.m., in the City Council Chamber of the City
Hall of the City of Baytown, Texas, which date is not more than forty (40) nor less than twenty (20) days prior
to the institution of annexation proceedings; and
WHEREAS, notices of such public hearings were published in a newspaper having general circulation
in the City of Baytown, Texas, and in the below described territories on the 12`s day of July, 2002, which date
is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearings; and
WHEREAS, the total corporate area of the City of Baytown, Texas, on the 1 st day of January, 2002,
was 32.43 square miles; and
WHEREAS, the population of the City of Baytown, Texas, is approximately 66,430 inhabitants; and
WHEREAS, the below described territories lie within the extraterritorial jurisdiction of the City of
Baytown, Texas; and
WHEREAS, the below described territories lie adjacent to and adjoin the City of Baytown, Texas;
NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section L That the following described land and territories lying adjacent to and adjoining the
City of Baytown are hereby added and annexed to the City of Baytown, Texas, and shall hereinafter be
included within the boundary limits of the City of Baytown, Texas, and present boundary limits of such City, at
the various points contiguous to the areas hereinafter described, are altered and amended so as to include said
areas within the corporate limits of the City of Baytown, Texas, to -wit:

Section 2: The above described territories and the areas so annexed shall be a part of the City of
Baytown, Texas, and the property so added hereby shall bear its pro rata of the taxes levied by the City of
Baytown, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens
of the City of Baytown and shall be bound by the acts, ordinances, resolutions, and regulations of the City of
Baytown, Texas.
® Section 3: In accordance with Texas Local Government Code Annotated § 43.056, as amended,
the service plan prepared by the City for providing municipal services to the annexed areas is attached as
Exhibit "B" and is hereby approved.
Section 4: This ordinance shall be published and passed in the manner provided in Article 1,
Section 9, of the Charter of the City of Baytown, Texas.

Come now, Roger Williams owner(s) of the real property described by metes and
bounds as follows:
FIELD NOTES of a 6.00 acre tract of land situated in the William Hilbus Survey, Abstract 336, Harris
County, Texas. Said 6.00 acres being out of and a part of that certain 6.00 acre tract of land conveyed by
Floyd D. Woods to Charles W. Caldwell, et ux, by Deed dated July 10, 1996 and recorded in County
Clerk's File No. 5015995 of the Official Public Records of Real Property of Harris County, Texas and out
of and a part of that certain 6.00 acre tract of land conveyed by Floyd D. Woods to Sterling Trust Company
by Deed dated July 10, 1996 and recorded in County Clerk's File No_ SO 15998 of the Official Public
Records of Real Property of Harris County, Texas. This 6.00 acre tract is more particularly described by
the following metes and bounds, to -wit:
NOTE: BEARINGS ARE BASED ON DEED BEARINGS AND FOUND MONUMENTS IN THE
NORTH LINE OF SAID 6.00 ACRE TRACT. REFERENCE IS MADE TO THE PLAT OF EVEN
DATE ACCOMPANYING THIS METES AND BOUNDS DESCRIPTION.
BEGINNING at a' /2 inch iron rod found in the East right-of-way line of Thompson Road (60 feet wide
right -of -way) at the Southwest comer of that certain 10.00 acre tract of land conveyed by Floyd D. Woods
to Mohammad A. Subedar and Shabana Subedar by Deed dated March 4, 1999 and recorded in County _
CIerk's File No. T584957 of the Official Public Records of Real Property of Harris County, Texas and the
Northwest comer of said 6.00 acres conveyed to Caldwell. Said point being the Northwest corner and
POINT OF BEGINNING of this tract; from which a %: inch iron rod found for the Northwest corner of said
10.00 acres bears North 02 deg. 40 min. 38 sec. West 408.06 feet.
THENCE: North 86 deg. 53 min 46 sec. East along the North line of this tract, the North line of said 6.00
acres conveyed to Caldwell, the North line of said 6.00 acres conveyed to Sterling Trust Company and the
South line of said 10.00 acres and at 556.91 feet pass a '/ inch iron rod found for the Northeast comer of
said 6.00 acres conveyed to Caldwell and the Northwest corner of said 6.00 acre tract conveyed to Sterling
Trust Company, in all, a total distance of 1089.66 feet to a'' /2 inch iron rod found in the West right -of -way
of the San Jacinto River Authority Canal Tract as described in Volume 1273 at Page 467 of the Deed
Records of Harris County, Texas, for the Southeast comer of said 10.00 acres, the Northeast corner of said
6.00 acres conveyed to Sterling Trust Company and the Northeast comer of this tract.
THENCE: South 08 deg. 53 rain. 46 sec. East along the East line of this tract, the East line of said 6.00
acres conveyed to Sterling Trust Company and the West line of said San Jacinto River Authority Canal
Tract for a distance of 238.26 feet to a t/2 inch iron rod, with cap, set for the Southeast comer of this tract.
THENCE: South 86 deg. 53 min. 46-sec. West along the South line of this tract, over and across said 6.00
acres conveyed to Sterling Trust Company and over and across said 6.00 acres conveyed to Caldwell for a
distance of 1115.47 feet to a '/z inch iron rod, with cap, set in the East right -of -way line of said Thompson
Road and the West line of said 6.00 acres conveyed to Caldwell, for the Southwest comer of this tract.
THENCE: North 02 deg. 40 min. 38 sec. West along the West line of this tract, the West line of said 6.00
acres conveyed to Caldwell and the East right -of -way line of said Thompson Road for a distance of 237.05
feet to the PLACE OF BEGINNING and containing within these boundaries 6.00 acres of land.

Baytown; and is vacant and without residents or on which fewer than three qualified
voters reside.

SUMMARY
The area to be annexed is located in the ETJ, south of Interstate 10, east on Thompson
Road.
Size of Area: The area proposed for annexation is approximately 6.00 acres shown on
the attached map.
Proposed Land Use: Commercial. Upon annexation, the property will be in the Mixed
Use (MU) zoning district.
Impact: As a result of this proposed annexation, no additional city facilities, vehicles, or
personnel will be required. For fire protection purposes, the project site will be assigned
to Fire Station 5.
Means of Accomplishment: The annexation will be accomplished from the existing city
limit line.
Public Input: Public Hearings will be held to allow for public input.
