Ordinance No. 9,395ORDINANCE NO. 9395
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, PRESCRIBING THE NUMBER OF POSITIONS IN EACH
CLASSIFICATION IN THE FIRE DEPARTMENT; PROVIDING A
REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, previously, the Chief of the City of Baytown Fire Department has
recommended to the City Council that certain positions in the Fire Department be reclassified
and renamed; and
WHEREAS, the last such recommendations were approved by the City Council on the
13`h day of February, 1992, and on the I I 1 day of February, 1993, via Ordinance Nos. 6150 and
6530, wherein the number of persons in each classification of the Fire Department was
established as follows:

WHEREAS, because of the amendment to the Charter requiring a minimum of four
personnel at each fire station, consisting of one officer, one fire equipment operator and two fire
fighters, the number of positions in the Fire Fighter classification must be adjusted; NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the number of positions in each classification in the fire department
shall be as follows:

Section 2: All ordinances or parts of ordinances inconsistent with the terms of this
® ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of
such inconsistency and in all other respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter covered by this ordinance.
Section 3: If any provision, section, exception, subsection, paragraph, sentence,
clause or phrase of this ordinance or the application of same to any person or the set of
circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall
not affect the validity of the remaining provisions of this ordinance or their application to other
persons or sets of circumstances and to this end all provisions of this ordinance are declared to be
severable.
Section 4: This ordinance shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
