® AN ORDINANCE OF THE CITY COUNCIL, CITY OF BAYTOWN, TEXAS,
REJECTING THE BIDS FOR RENOVATIONS TO FIRE STATION NO. 1
RECEIVED ON JULY 19,2002; AUTHORIZING AND DIRECTING THE CITY
MANAGER AND CITY CLERK TO EXECUTE AND ATTEST TO A
CONTRACT WITH G &Z CONTRACTING, INC., FOR THE RENOVATION OF
FIRE STATION NO. 1; AUTHORIZING PAYMENT OF THE SUM OF TWO
HUNDRED EIGHTY -FIVE THOUSAND AND NO 1100 DOLLARS ($285,000.00);
MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR
THE EFFECTIVE DATE THEREOF.
WHEREAS, the City of Baytown advertised for bids for the. of Fire Station No. I

to be received June 21, 2002; and-
WHEREAS, notice to bidders as to the time and place, when and where the contract for said
construction would be let was published pursuant to provisions of Texas Local Government Code
Annotated § 252.041; and
WHEREAS, the only bid the City received was opened and publicly read at City Hall at 2:00
o'clock p.m., Friday, June 21, 2002, as per published notice to bidders; and
WHEREAS, because the City received only one bid, the City of Baytown advertised again for
bids for the renovation of Fire Station No. 1 to be received July 19, 2002; and
WHEREAS, for this second requests for bids, notice to bidders as to the time and place,
when and where the contract for said construction would be let was published pursuant to provisions
of Texas Local Government Code Annotated § 252.041; and
WHEREAS, all of the bids the City received in response to this second request forbids were
opened and publicly read at City Hall at 2:00 o'clock p.m., Friday, July 19, 2002, as per published
notice to bidders; and
WHEREAS, the City Council of the City of Baytown herein determines that the lowest
responsible bidder that provides the services at the best value for the City of Baytown is the bidder
whose bid was opened and publicly read on June 21, 2002; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby rejects all bids that were
received at 2:00 o'clock p.m., Friday, July 19, 2002, as per the published notice to bidders.
Section 2: That the City Council of the City of Baytown hereby accepts the bid of G &Z
is Contracting, Inc., for the renovation of Fire Station No. 1 according to the plans and specifications
set forth by the City's Architect for the sum of TWO HUNDRED EIGHTY -FIVE THOUSAND

AND NO /100 DOLLARS ($285,000.00) and authorizes payment thereof, and the City Manager and
the City Clerk of the City are hereby authorized and directed to execute and attest to a contract with
G &Z Contracting, Inc., for the above - described work, said contract containing the plans,
specifications, and requirements of the City's Architect and appropriate bond requirements in
accordance with the provisions of Texas Government Code, Chapter 2253.
Section 3: That the administration is authorized to contract for utility adjustments,
laboratory testing, and other professional services necessary to the operation and completion of the
project.
Section 4: That pursuant to the provisions of Texas Local Government Code Annotated §
252.048, the City Manager is hereby granted general authority to approve any change order involving
a decrease or an increase in costs of TWENTY -FIVE THOUSAND AND NO /100 DOLLARS
($25,000.00) or less, subject to the provision that the original contract price may not be increased by
more than twenty -five percent (25 %) or decreased by more than twenty -five percent (25 %) without
the consent of the contractor to such decrease.
Section 5: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City
of Baytown this the 25th day of July, 2002.
