AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AMENDING ORDINANCE NO.. 9329, PASSED ON FEBRUARY 28, 2002, TO
PROVIDE FOR THE EFFECTIVE DATE TO AMEND THE CITY CHARTER BY
ADDING SECTION 22.1 "FIRE DEPARTMENT STAFFING "; PROVIDING A
REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That Section 1 of Ordinance No. 9329, passed by the City Council of the City of
Baytown, Texas, on February 28, 2002, is hereby amended to read as follows:
Section 1: That the Special Municipal Election of the City of Baytown, as
prescribed in Article XII, Section 138 of the Charter of the City of Baytown and pursuant
to Sections 41.001 and 41.031 of the Texas Election Code, shall be held between the
hours of seven o'clock (7:00) a.m. and seven o'clock (7:00) p.m. on the 40' day of May,
2002, in the City of Baytown, Texas, for the purpose of amending Article H "The
Council" of the Charter of the City of Baytown by adding Section 22.1 "Fire department
staffing" and providing for the date of October 1, 2002, as the date the City Charter
amendment goes into effect. Such article shall read as foI]lows:
ARTICLE H. THE COUNCIL
Sec. 22.1. Fire department staffing.
The fire department of the city shall maintain and operate a
minimum of five (5) fire stations. Each fire station shall have in
operation at all times a minimum of one (1) fire emergency vehicle,
which shall be staffed by a minimum of four (4) personnel, including one
(1) officer, one (1) fire equipment operator, and two (2) fire fighters.
Section 2: That Section 2 of Ordinance No. 9329, passed by the City Council of the City of
Baytown, Texas, on February 28, 2002, is hereby amended to read as follows:
Section 2: That the form of the ballot for said election shall be substantially
as follows:
PROPOSITION NO. 1
Adding Article H "The Council," Section 22.1 "Fire department staffing" to the Charter
of the City of Baytown to require a minimum of five fire stations, a minimum of one fire
emergency vehicle at each station and a minimum of four personnel, consisting of one
officer, one fire equipment operator and two firefighters at each station. This Charter
amendment shall become effective as of October 1, 2002.

Section 3: All ordinances or parts' of ordinances inconsistent with the terms of this
ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating
and governing the subject matter covered by this ordinance.
Section 4: If any provision, section, exception, subsection, paragraph, sentence, clause or
phrase of this ordinance or the application of same to any person or the set of circumstances, shall for any
reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the
remaining provisions of this ordinance or their application to other persons or sets of circumstances and to
this end all provisions of this ordinance are declared to be severable.
Section 5: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown, Texas.
