ORDINANCE NO. 9332
® AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER TO
EXECUTE AND THE CITY CLERK TO ATTEST TO AMENDMENT NO.2 TO
THE AGREEMENT FOR JAIL, TRAFFIC AND INVESTIGATION SERVICES
AND JAIL AND COMMUNICATIONS IMPROVEMENTS WITH THE
BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT TO INCREASE
FUNDING IN YEAR 4 TO PAY FOR THE CAPITAL OUTLAY FOR THE JAIL
FACILITY AND RADIO SYSTEM FOR YEARS 5 THROUGH 10 IN THE
AMOUNT OF FOUR MILLION FOUR HUNDRED EIGHTY -TWO THOUSAND
ONE HUNDRED SEVENTY -TWO AND 50 /100 DOLLARS ($4,482,172.50);
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes and
directs the City Manager and City Clerk of the City of Baytown to execute and attest to Amendment
No. 2 to the Agreement for Jail, Traffic and Investigation Services and Jail and Communications
Improvements with the Baytown Crime Control and Prevention District to increase funding in year 4
to pay for the capital outlay for the jail facility and radio system for years 5 through 10 in the amount
of FOUR MILLION FOUR HUNDRED EIGHTY -TWO THOUSAND ONE I- IUNDRED
SEVENTY -TWO AND 50/100 DOLLARS ($4,482,172.50). A copy of said Agreement is attached
hereto, marked Exhibit "A," and made a part hereof for all intents and purposes.
Section 2: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City

This Amendment ( "Amendment ") to that certain Agreement for Jail, Traffic and Investigation
Services and Jail and Communications Improvements by and between the CITY OF BAYTOWN, a
municipal corporation located in Hams and Chambers Counties, Texas, (the "City, ") and the
BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT, a crime control and
prevention district created under Chapter 363 of the Texas Local Government Code, located in
Harris and Chambers Counties, Texas, (the "District "), is made by and between the same parties on
the date hereinafter last specified.
For and in consideration of the mutual covenants and agreements herein contained, the parties
hereto do hereby mutually agree as follows:
I.
Unless a different meaning clearly appears from the context, words and phrases as used in
this Amendment shall have the same meanings as in the Agreement.
Section 5 "Funds to be provided by the District" is hereby amended, in part, to read as
follows:
For and in consideration of the services to be provided by the City in
furtherance of the District's programs listed in Section 2, (d) and (e) of the
Agreement For Jail, Traffic and Investigation Services and Jail and Communications
Improvements approved by the District and the City on May 14, 1998, and amended
on June 29, 2001, the District shall provide the following funds to the City in the
amounts and for the programs hereinbelow listed:

The provisions of this Amendment and the Agreement should be read together and construed
as one agreement provided that, in the event of any conflict or inconsistency between the provisions
of this Amendment and the provisions of the Agreement, the provisions of this Amendment shall
control.
IN WITNESS WHEREOF, the parties have made and executed this contract in multiple
copies, each of which shall be an original on this the 14th day of March, 2002.
