ORDINANCE NO. 9292
AN ORDINANCE PROVIDING FOR THE DISCONTINUANCE OF AN AREA AS PART
OF THE CITY OF BAYTOWN, TEXAS, BY DISANNEXING THE PROPERTY
OCCUPIED BY FIRST CHEMICAL COMPANY, L.P., WHICH PROPERTY WAS
PREVIOUSLY ANNEXED VIA ORDINANCE NO. 2516; MAKING OTHER
PROVISIONS RELATED THERETO.
WHEREAS, there being no request for an "on- site" hearing, two public hearings before the City
Council of the City of Baytown, Texas, where all interested persons were provided with an opportunity to be
heard on the proposed disannexation of the property described in Section 1 of this ordinance, were held, one at
6:45 p.m. and the other at 6:50 p.m., on the 13`h day of December, 2001, in the City Council Chambers of the
City Hall of Baytown, Texas, which date is not more than forty (40) nor less than twenty (20) days prior to the
institution of disannexation proceedings; and
WHEREAS, notices of such public hearings were published in a newspaper having general circulation
in the City of Baytown, Texas, and in the below described territories on the 26'h day of November, 2001, which
date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearings; and
WHEREAS, the total corporate area of the City of Baytown, Texas, on the 1 st day of January, 2002,
was 32.43 square miles and the population of the City of Baytown, Texas, is approximately 66,430 inhabitants;
and
WHEREAS, the below - described territories lie within the incorporated limits of the City of Baytown,
Texas; and
WHEREAS, the City Council of the City of Baytown has conducted the disannexation proceedings of
its own accord pursuant to the Charter and the procedural rules prescribed by Chapter 43 of the Texas Local
Government Code; and
WHEREAS, on the 13`h day of February, 1997, the City of Baytown entered into an Industrial District
Agreement with First Chemical Company, L.P., (the "Company ") regarding the below - described territories,
whereby the Company agreed to make industrial district payments in lieu of tax payments; and
WHEREAS, the Company has been assessed ad valorem taxes rather than the industrial district
assessments; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the land and territories lying within the incorporated limits of the City of
Baytown, more particularly described in Exhibit "A," which is attached hereto and incorporated herein for all
intents and purposes, are hereby disannexed and discontinued as part of the area within the incorporated limits
of the City of Baytown, Texas.
Section 2: That the City of Baytown tax records be adjusted to reflect acceptance of the industrial
district payments in lieu of tar payments for the years 1998, 1999, 2000 and 2001.
Section 3: This ordinance shall be published and passed in the manner provided in Article 1,
® Section 9, of the Charter of the City of Baytown, Texas.
