® AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER TO
EXECUTE AND THE CITY CLERK TO ATTEST TO AMENDMENT NO. 1 TO
THE AGREEMENT FOR JAIL, TRAFFIC AND INVESTIGATION SERVICES
AND JAIL AND COMMUNICATIONS IMPROVEMENTS WITH THE
BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT TO
AUTHORIZE THE HIRING OF FIVE JAILER SUPERVISORS; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes and
directs the City Manager and City Clerk of the City of Baytown to execute and attest to Amendment
No. 1 to the Agreement for Jail, Traffic and Investigation Services and Jail and Communications
Improvements with the Baytown Crime Control and Prevention District to authorize the hiring of
five j ailer supervisors. A copy of said Agreement is attached hereto, marked Exhibit "A," and made
a part hereof for all intents and purposes.
Section 2: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City
of Baytown this the 29th day of June, 2001.

AMENDMENT NO. 1
TO THE AGREEMENT FOR JAIL, TRAFFIC AND INVESTIGATION
SERVICES AND JAIL AND COMMUNICATIONS IMPROVEMENTS

This Amendment ( "Amendment ") to that certain Agreement for Jail, Traffic and Investigation
Services and Jail and Communications Improvements" by and between the CITY OF BAYTOWN,
a municipal corporation located in Harris and Chambers Counties, Texas, (the "City, ") and the
BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT, a crime control and
prevention district created under Chapter 363 of the Texas Local Government Code, located in
Harris and Chambers Counties, Texas, (the "District "), is made by and between the same parties on
the date hereinafter last specified.
For and in consideration of the mutual covenants and agreements herein contained, the parties
hereto do hereby mutually agree as follows:
I.
Unless a different meaning clearly appears from the context, words and phrases as used in
this Amendment shall have the same meanings as in the Agreement.
II.
Section 2 "Description of Programs" is hereby amended, in part, to read as follows:
The City, with the assistance of the District as herein specified, agrees to
develop, organize and manage the following programs, including entering into and
administering all contracts incident thereto:
C) Jail Operations. This program will provide operating costs for the new jail
and will create fourteen (14) new jail personnel positions in the City's police
department, thus providing the needed personnel to better manage the current
and expanded jail facilities.
III.
Section 5 "Funds to be provided by the District" is hereby amended, in part, to read as
follows:

For and in consideration of the services to be provided by the City in
furtherance of the District's programs listed in Section 2, the District shall provide
the following funds to the City in the amounts and for the programs hereinbelow
listed:
IV.
The provisions of this Amendment and the Agreement should be read together and construed
as one agreement provided that, in the event of any conflict or inconsistency between the provisions
of this Amendment and the provisions of the Agreement, the provisions of this Amendment shall
control.

copies, each of which shall be an original.
