The City Council of the City of Baytown, Texas, met in a Regular Meeting on Thursday, January
23, 2020, at 6:31 P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street,
Baytown, Texas with the following in attendance:

Mayor Capetillo convened the January 23, 2020, City Council Regular Meeting with a quonun
present at 6:31 P.M., all members were present with the exception of Council Member Himsel
who was absent.
Pledge of Allegiance, Texas Pledge, and Invocation was led by Council Member Hoskins.
1. MINUTES
a. Consider approving the minutes of the City Council Work Session and Regular
Meeting held on January 09, 2020.
A motion was made by Council Member Charles Johnson and seconded by Council Member
Laura Alvarado approving the January 09, 2020, City Council Work Session and Regular
Meeting minutes. The vote was as follows:

Director of Human Resources, Carol Flynt presented the agenda item and recognized City of
Baytown employees for their years of services.

Consent agenda item 3.c. was suspended to the next meeting, as the item was not ready for
consideration.
A motion was made by Council Member Chris Presley and seconded by Council Member
Heather Betancourth approving consent agenda items 3.a., 3.b., and 3.d. through 31 The vote

Rehabilitation Project - Year 2, and release of retainage to SKE Construction, LLC.
ORDINANCE NO. 14,314
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, ACCEPTING THE 2018 ANNUAL WATERLINE REHABILITATION
PROJECT - YEAR 2; AUTHORIZING FINAL PAYMENT OF THE SUM OF
FIFTY-ONE THOUSAND FOUR HUNDRED EIGHTEEN AND 98/100
DOLLARS ($51,418.98) TO SKE CONSTRUCTION, LLC, FOR SAID
PROJECT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

b. Consider an ordinance authorizing a contract with Hutchison & Associates for
professional services for the survey, layout, design, engineering and permitting of the
proposed Goose Creek Trail phase VII and VIII.
ORDINANCE NO. 14,315
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT
WITH BUSCH, HUTCHISON AND ASSOCIATES, INC., D/B/A HUTCHISON
& ASSOCIATES, FOR SURVEY, LAYOUT, DESIGN, ENGINEERING AND
PERMITTING SERVICES RELATED TO THE PROPOSED GOOSE CREEK
TRAIL PHASES VII AND VIII; AUTHORIZING PAYMENT BY THE CITY
OF BAYTOWN IN AN AMOUNT NOT TO EXCEED SIXTY THOUSAND
THREE HUNDRED AND NO/100 DOLLARS ($60,300.00); MAKING OTHER
PROVISIONS RELATED THERETO; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
d. Consider an ordinance authorizing a Clinical Affiliation Agreement with Texas
A&M Engineering Extension Service for on -site clinical and practical training.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE A CLINICAL
AFFILIATION AGREEMENT WITH TEXAS A&M ENGINEERING
EXTENSION SERVICE FOR ON -SITE CLINICAL AND PRACTICAL
TRAINING; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
e. Consider an ordinance authorizing an interlocal agreement for cooperative
purchasing with the City of Buda.
ORDINANCE NO. 14,317
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE AND THE
CITY CLERK TO ATTEST TO A COOPERATIVE PURCHASING
AGREEMENT WITH THE CITY OF BUDA; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
L Consider an ordinance to award the Annual Water Meter Valve Replacement
Contract to CM City Solutions, LLC.

ORDINANCE NO. 14,318
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, ACCEPTING THE BID OF CM CITY SOLUTIONS, LLC, FOR THE
ANNUAL WATER METER VALVE REPLACEMENT CONTRACT AND
AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN THE SUM OF
ONE HUNDRED TWENTY THOUSAND AND NO/100 DOLLARS
($120,000.00); MAKING OTHER PROVISIONS RELATED THERETO; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
3.c. Consider an ordinance authorizing an Addendum to Engagement Letter with
Bracewell LLP, for legal services associated with the creation of one or more public
improvement districts and the issuance of bonds and other debt obligations related thereto.
A motion was made by Mayor Pro Tem Robert C. Hoskins and seconded by Council Member
Laura Alvarado approving to suspend consent agenda item 3.c. to the next meeting. The vote was
as follows:

4. APPOINTMENTS
a. Conduct the election of the Baytown City Council Mayor Pro Tem.
Mayor Capetillo presented the agenda item and stated that Council Member Himsel would serve
as Mayor Pro Tem, but due to scheduling conflicts, requested not to serve this term; therefore,
per the Council rules, the next Council Member for consideration was Council Member Laura
Alvarado, District No. 1.
A motion was made by Council Member Charles Johnson and seconded by Council Member
Presley approving the confirmation of Council Member Alvarado as Mayor Pro Tem from July
01, 2020 through December 31, 2020. The vote was as follows:

b. Consider confirming the Mayor's appointments to the Bring the Battleship to
Baytown Committee.
Mayor Capetillo presented the agenda item and continued his appointments of Council Member
Laura Alvarado as the primary representative and Council Member David Himsel as the alternate
representative to the Bring the Battleship to Baytown Committee. He further noted that there was
a productive meeting regarding the subject matter, in which the proposal for such would be due
mid -March. Additionally, he noted that the Battleship Texas Foundation released their request
for a proposal.
A motion was made by Mayor Pro Tem Robert C. Hoskins and seconded by Council Member
Chris Presley approving the confirmation of Mayor Capetillo's appointments of Council Member

C. Consider the appointment of Kelly Benavides, Michael Marks and Andy Helms as
Associate Municipal Court Judges for the term of office, which begins February 01, 2020,
and ends on January 31, 2022.
Mayor Capetillo presented the agenda item to consider the appointments of Kelly Benavides,
Michael Marks and Andy Helms as Associate Municipal Court Judges for the term of office,
which begins February 01, 2020, and ends on January 31, 2022, but further noted that he
submitted a conflict of interest form with the City Clerk's Office and abstained from the vote.
A motion was made by Council Member Chris Presley and seconded by Council Member
Charles Johnson approving the appointments of Kelly Benavides, Michael Marks, and Andy

Helms as Associate Municipal Court Judges for the term of office, which begins February 01,

d. Consider authorizing the Mayor to consent to and approve the appointment of
Chris Canonico as the Harris County Municipalities Waste Disposal Council's
representative to the Gulf Coast Waste Disposal Authority Board of Directors effective
January 31, 2020.
Mayor Capetillo presented the agenda item to consent and approve the appointment of Chris
Canonico as the Harris County Municipalities Waste Disposal Council's representative to the
Gulf Coast Waste Disposal Authority Board of Directors effective January 31, 2020.
Ms. Flynt recognized Elsa Tobias, Police Patrol Officer, for her 20 years of service to the City of
Baytown.
A motion was made by Council Member Laura Alvarado and seconded by Council Member
Charles Johnson approving the appointment of Chris Canonico as the Hams County
Municipalities Waste Disposal Council's representative to the Gulf Coast Waste Disposal
Authority Board of Directors effective January 31, 2020. The vote was as follows:

5. MANAGER'S REPORT
a. The 19'h Annual "Daddy Daughter" Dance will be held at the Baytown Community
Center on Friday and Saturday, February 07 and 08, 2020.
Parks and Recreation Director, Scott Johnson presented the agenda item and stated that the
Baytown Parks and Recreation's 19* annual Daddy Daughter Dance would be held at the
Baytown Community Center on Friday, February 08, 2020, from 6:00 P.M. to 9:00 P.M. and
again on Saturday, February 09, 2020 from 2:00 P.M. to 5:00 P.M.
City Manager Davis acknowledged Officer David Holland for receiving his Master Peace Officer
Certificate.
6. EXECUTIVE SESSION
a. Recess into and conduct an executive session pursuant to Texas Government Code,
Section 551.071 to seek the advice of the City's attorneys regarding pending
litigation involving the City of Baytown.
At 6:50 P.M., Mayor Capetillo recessed into and conducted an executive session pursuant to
Texas Government Code, Section 551.071 to seek the advice of the City's attorneys regarding
pending litigation involving the City of Baytown.
At 7:18 P.M., Mayor Capetillo reconvened the Open Meeting of the Regular City Council
Meeting and announced that in accordance with Section 551.102 of the Texas Government Code,
no action was taken in the Executive Session.
7. ADJOURN
With there being no further business to discuss, Mayor Capetillo adjourned the January 23,
2020, City Council Regular Meeting at 7:19 P.M.
