Ordinance No. 9,161ORDINANCE NO. 9161 ® AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, SETTING A DATE, TIME AND PLACE FOR A PUBLIC HEARING CONCERNING THE CREATION OF REINVESTMENT ZONE NUMBER ONE, CITY OF BAYTOWN AND ITS BENEFITS TO THE CITY AND TO THE PROPERTY WITHIN THE ZONE; AUTHORIZING THE CITY CLERK TO PUBLISH NOTICE OF SUCH PUBLIC HEARING; AUTHORIZING AND DIRECTING THE CITY MANAGER TO GIVE NOTICE AND MAKE PRESENTATIONS AS REQUIRED BY THE TAX INCREMENT FINANCING ACT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Section 2: The City Clerk of the City of Baytown is hereby authorized and directed to cause notice of the public hearing to be published once in the newspaper having general circulation in the City not later than the seventh (7th) day prior to the date of the public hearing, all in accordance with Section 311.003 of the Texas Tax Code. Section 3: The City Manager of the City of Baytown is hereby authorized and directed to give notice in writing of the City Council's intent to establish the Zone. Such notice is attached hereto as Exhibit "B" and incorporated herein for all intents and purposes. Section 4: The City Manager of the City of Baytown is hereby authorized and directed to make presentations to the governing bodies of Harris County, Lee College and Goose Creek Consolidated Independent School District and to give notice of each such presentation to the taxing entities that levy taxes in the Zone. The presentation referred to in this section is dated May 24, 2001, and on file in the City Clerk's office. Section 5: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. This notice is provided in writing to each taxing unit that levies real property taxes in a proposed Tax Increment Reinvestment Zone. On the 26th day of July, 2001, at 6:45 p.m. in the Council Chamber of Baytown City Hall, 2401 Market Street, Baytown, Texas; the City Council of the City of Baytown will hold a public hearing on the creation of the proposed zone and its benefits to the City and to the property in the proposed zone. The proposed Tax Increment Reinvestment Zone (TIRZ) will include over 350 acres of land in the Garth Road — 1 -10 area. The proposed TIRZ is described in Exhibit A, as shown on the enclosed Preliminary Description of Tax Increment Zone Number One, City of Baytown. The zone is proposed to promote development in the area because the City believes that development would not occur solely through private investments in the reasonably foreseeable future. The preliminary redevelopment plan anticipates the development of residential units, commercial and retail space. Project costs to be financed by the zone include land assembly costs, street and sidewalk improvements, water, sanitary sewer, and storm sewer improvements, park space, streetscape, and lighting. The 2000 appraised value of the area is approximately $51.0 million. These projects are expected to increase taxable real property values in the zone. IBI' Tax Increment Reinvestment Zone Page 2 Pursuant to Texas Tax Code, Section 311.003(f) the City is required to make a formal presentation to the governing body of school district and county that levies real property taxes in the proposed zone. The Tax Code provides that a single presentation can be made to the governing bodies of these taxing entities if the county and school district agree upon a time and place. Please advise me whether this acceptable, or whether you desire a separate presentation. Further, Texas Tax Code, Section 311.003(g) requires that no later than the 15"' day after the date on which this notice is given, each taxing unit that levies real property taxes in the proposed reinvestment zone shall designate a representative to meet with the City Council to discuss the project plan and the reinvestment zone financing plan. I am also requesting that your jurisdiction designate a representative who will be available to meet with the City staff concerning the proposed reinvestment zone and notify me of the person(s) designated.
