® AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN ADDING A
1.961 -ACRE TRACT LOCATED ON HUNT ROAD EAST OF AND ADJACENT TO
HUNT GARDEN APARTMENTS TO COUNCIL DISTRICT NO. 4; REPEALING
ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE;
AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF.
WHEREAS, Section 17(1) of the Charter of the City of Baytown provides that the City Council shall
redistrict the City if the growth of the City justifies; and
WHEREAS, it is necessary to include the newly annexed territory described herein in a Council
District; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: Council District No. 4 is hereby redistricted by the addition of certain property, which
is described on the attached Exhibit "A."
Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are
hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject
matter covered by this ordinance.
Section 3: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase
of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held
unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this
ordinance or their application to other persons or sets of circumstances and to this end all provisions of this
ordinance are declared to be severable.
Section 4: This ordinance shall take effect from and after ten (10) days from its passage by the
City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance
to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after
passage of this ordinance.

Being a 1.961 acre tract or parcel of land situated in the William C. and Charles Boswell Survey, Abstract
No. 1562, Harris County, Texas and being all of a called 10 acre tract from J. f. Kubelka to George S. Burt
as described in deed dated August 15, 1963, and recorded in Harris County Clerks File No. B746436,
SAVE AND EXCEPT the following four (4) tracts or parcels of land; 1) a called 3 acre tract as described
in deed to Rufus Lee Larkin recorded in Harris County Clerks File No. D 856877, 2) a called 2 acre tract to
Billy Wayne Ashley recorded in Harris County Clerks File No. E 188988, 3) a called 1 '/z acre tract to
Norman E. Perkins recorded in Harris County Clerks File No. F 805575, and 4) a called 11 /2 acre tract to
Lucy Perkins recorded in Harris County Clerks File No. F 805577, said remaining tract being more
particularly described by metes and bounds as follows;
BEGINNING at a 5/8" iron rod found on the north line of Hunt Road, and the south line of the said called
Burt 10 acre tract, for the southwest corner of the said Lucy Perkins called 11 /2 acre tract, and the southeast
corner of the herein described tract;
THENCE S 80 027'00" W, along the north line of Hunt Road, and the south line of the said called 10 acre
tract, a distance of 129.90 feet to a 1 /2" iron rod with plastic cap stamped "RPLS 4980 ", set for the
southeast corner of Hunt Garden Apartments, as shown on the map or plat thereof recorded in Volume 323
Page 93 of the Map Records of Harris County, Texas, for the southwest corner of the herein described tract;

THENCE N 09 033'23" W, called N 10'30'15" W, along the east line of the said Hunt Garden Apartments,
a distance of 660.51 feet, called 660.00 feet, to a'' /z" iron rod found on the north line of the said called 10
acre tract, for the northeast corner of said Hunt Garden Apartments, for the northwest corner of the herein
described tract;
THENCE N 80 °26'00" E, along the north line of the said called 10 acre tract, a distance of 128.76 feet, to a
point for corner, from which a found 518" iron rod bears S 09 039'21" E a distance of 0.95 feet, for the
northwest corner of the said Lucy Perkins called 11/2 acre tract; for the northeast corner of the herein
described tract;
THENCE S 09 039'21" E, called S 09 °33'00" E, along the west line of the said Lucy Perkins called 11 /2
acre tract, a distance of 660.55 feet, called 660.00 feet, to the POINT OF BEGINNING, containing within
these metes and bounds a calculated area of 1.961 acres of land.
