Ordinance No. 9,12920010308 -11 ORDINANCE NO. 9129 ® AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING ORDINANCE NO. 9111, PASSED ON FEBRUARY 8, 2001, AND ORDINANCE NO. 9112, PASSED ON FEBRUARY 22, 2001, TO NAME THE ELECTION OFFICIALS FOR THE REGULAR AND SPECIAL ELECTIONS TO BE HELD ON MAY 5, 2001, TO SET THE DATE THAT THE RETURNS WILL BE CANVASSED AND TO SET THE DATE THAT ANY RUNOFF ELECTION THAT MAY BE NECESSARY WILL BE HELD; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. *********************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Section 14 of Ordinance No. 9111, passed by the City Council of the City of Baytown, Texas, on February 8, 2001, and Section 3 of Ordinance No. 9112, passed by the City Council of the City of Baytown, Texas, on February 22, 2001, are hereby amended to read as follows: That the City is hereby divided into Election Precincts, having the following polling places and election officials for the purpose of these elections: PRECINCT NO. Cardwell (Consisting of that portion of 300 Cedar Bayou Road Judge & Presiding Officer Harris County Voting Precinct No. 533 within the Tammy Cardwell City) Alternate Judge Section 2: That Ordinance No. 9111, passed by the City Council of the City of Baytown, Texas, on February 8, 2001, and Ordinance No. 9112, passed by the City Council of the City of Baytown, Texas, on February 22, 2001, are hereby amended to add two new sections, which read as follows: 2 20010308 -11b Section 23: That pursuant to Section 67.003 of the Texas Election Code, the date of canvassing the municipal and special elections shall be the 10th day of May, 2001. Section 24: That pursuant to Section 2.025 of the Texas Election Code, any runoff election which may be necessary based upon the canvassed precinct returns of the municipal election shall be held on the 2nd day of June, 2001, in the City of Baytown, Texas. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be `cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or the set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown, Texas.
