® AN ORDINANCE OF THE CITY OF BAYTOWN, TEXAS, AMENDING CHAPTER
30 "EMERGENCY SERVICES," ARTICLE III "EMERGENCY MEDICAL
SERVICES," DIVISION 1 "GENERALLY," SECTION 30 -91 "DEFINITIONS," AND
DIVISION 3 "SERVICES," SECTION 30 -153 "FEES" OF THE CODE OF
ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, TO REVISE EMERGENCY
MEDICAL SERVICE CHARGES AND CONFORM THE SAME TO THE MEDICARE
REIMBURSEMENT GUIDELINES; PRESCRIBING A MAXIMUM PENALTY OF
TWO THOUSAND AND NO /100 DOLLARS ($2,000.00); PROVIDING A
REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING
FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That Chapter 30 "Emergency Services," Article III "Emergency Medical
Services," Division l "Generally," Section 30 -91 "Definitions" of the Code of Ordinances, City of
Baytown, Texas, is hereby amended to read as follows:
CHAPTER 30 EMERGENCY SERVICES
ARTICLE III. EMERGENCY MEDICAL SERVICES
Division 1. Generally
Sec. 30-91. Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings
ascribed to them in this section, except where the context clearly indicates a different meaning:
Advanced life support, emergency means an emergency circumstance that requires advanced
emergency pre - hospital care that uses invasive medical acts to treat a serious medical condition.
Advanced life support, II, emergency means an emergency circumstance that requires advanced
emergency pre - hospital care that uses invasive medical acts and administration of three or more
medications to treat a life - threatening condition.
Ambulance means any vehicle used, designed or redesigned for the purpose of transporting the
sick and injured.
Basic life support, emergency means an emergency circumstance, not requiring advanced life
support, but requiring emergency pre - hospital care using noninvasive medical acts for the
treatment of an individual whose health or condition would be endangered by other means of transport.
City limits means that area in the city within its corporate limits, plus the plant sites of those
industries that have an industrial district agreement with the city, whether or not such plant site is within
or without the corporate limits of the city.
Committee means the city's emergency medical service advisory committee created in division 2
of this article.
0 Director means the director of the city's health department.

® Emergency circumstances means the existence of circumstances in which the elements of time
and expeditious transporting of an injured person for medical or surgical treatment are essential to the
health or life of such person, in which rescue operations or competent first aid or both at the place of the
emergency may be essential to the health or life of such person.
Emergency medical services means services used to respond to an individual's perceived need for
immediate medical care and to prevent death or aggravation of physiological or psychological illness or
injury, performance of the necessary rescue operations, rendering of any necessary first aid assistance or a
trip to the hospital or other place for medical attention.
Emergency medical services vehicle means:
(1) A basic life - support emergency medical services vehicle;
(2) An advanced life - support emergency medical services vehicle;
(3) A mobile intensive -care unit; or
(4) A specialized emergency medical services vehicle.
EMS division means the EMS division of the city.
Medical transfer service means a response made by an ambulance for the transportation of
individuals to or from a medical facility, a nursing home or residence under circumstances which do not
constitute an emergency.
Medical transfer service permit means a certificate of authorization issued by the city to the
owner allowing such owner to operate an ambulance for medical transfer services within the city limits.
Medical transfer service provider means a person providing medical transfer services and holding
a valid medical transfer services permit.
State department of health means Texas Department of Health as presently constituted, or any
successor agency.
Section 2: That Chapter 30 "Emergency Services," Article I111 "Emergency Medical
Services," Division 3 "Services," Section 30 -153 "Fees" of the Code of Ordinances, City of Baytown,
Texas, is hereby amended to read as follows:

(a) To partially defer the cost incurred by the city in providing emergency medical service, the
following basic fees are established to be collected from the user of emergency medical service
provided by the city:

(c) Bills for emergency medical service that have not been paid within 30 days of the date that such
bill was mailed by the city shall be deemed delinquent. Delinquent bills for emergency medical
service shall be charged ten percent interest, plus reasonable attorney's fees if a lawsuit is filed to
collect the delinquency.
Section 3: Any person who fails to comply with any provision of this ordinance shall be
guilty of a misdemeanor and, upon conviction, shall be punished by a fine not exceeding TWO
THOUSAND AND NO /100 DOLLARS ($2,000.00). Each act of violation and each day upon which any
such violation shall occur shall constitute a separate offense. In addition to the penalty prescribed above,
the city may pursue other remedies such as abatement of nuisances, injunctive relief, administrative
adjudication and revocation of licenses or permits.
Section 4: All ordinances or parts of ordinances inconsistent with the terms of this
ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be cumulative or other ordinances regulating
and governing the subject matter covered by this ordinance.
Section 5: If any provision, section, exception, subsection, paragraph, sentence, clause or
phrase of this ordinance or the application of same to any person or the set of circumstances, shall for any
reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the
remaining provisions of this ordinance or their application to other persons or sets of circumstances and to
this end all provisions of this ordinance are declared to be severable.
Section 6: This ordinance shall take effect from and after ten (l 0) days from its passage by
the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this
ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10)
isdays after passage of this ordinance.
