CollectiveBargaining4FireNEffectAN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, PLACING THE FIRE AND POLICE EMPLOYEE RELATIONS ACT AS APPLICABLE TO FIRE FIGHTERS INTO EFFECT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ****************************************************************************************** WHEREAS, a petition was tendered to the City Clerk for the purpose of submitting to the voters the question of collective bargaining for the fire fighters of the City of Baytown; and WHEREAS, the City Clerk has verified the petition as containing signatures of at least 5% of the voters voting in the City during the last general election for state and county officials; and WHEREAS, the City Council held a special election on the 6th day of May, 2000, for the purposes of voting for or against referendum concerning the adoption of the state law applicable to fire fighters that establishes collective bargaining, preserves the prohibition against strikes and lockouts and provides penalties for strikes and lock-outs; and WHEREAS, 51% of the voters who voted in such election concerning the above-referenced referendum voted for the same; and WHEREAS, a majority of the fire fighters favor representation by an employees association; and WHEREAS, since a majority of the votes cast in the referendum election favored the adoption of the Fire and Police Employee Relations Act as applicable to the fire fighters, the City Council must place such chapter into effect; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby places the Fire and Police Employee Relations Act, Chapter 174 of the Texas Local Government Code, into effect as applicable to fire fighters of the City of Baytown, Texas. Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
