OCTOBER 3, 2019
The City Council of the City of Baytown, Texas, met in a Special Meeting on Thursday, October
3, 2019, at 4:36 P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street,
Baytown, Texas with the following in attendance:

Mayor Capetillo convened the October 3, 2019, City Council Special Meeting with a quorum
present at 4:36 P.M., all members were present with the exception of Council Members Alvarado
and Johnson who were absent.
1. PROPOSED RESOLUTIONS
a. Consider an ordinance adopting the tax rate for General Fund Maintenance and
Operations at $0.46093 per $100 valuation for the fiscal year ending September 30, 2020,
and adopting the tax rate for Debt Service at $0.34110 per $too for the fiscal year ending
September 30, 2020.
Finance Director Wade Nickerson presented the item and stated that the proposed ordinance
adopts the tax rate for General Fund Maintenance and Operations at $0.46093 per $100 valuation
for the fiscal year ending September 30, 2020, and adopting the tax rate for Debt Service at
$0.34110 per $100 for the fiscal year ending September 30, 2020. The City's tax rate consists of
the following two components, each of which must be approved separately:
L 'Be rate that, if applied to the total taxable value, will impose the amount of taxes
needed to pay debt service; and
2. The rate that, if applied to the total taxable value, will impose the amount of taxes
needed to fund maintenance and operation expenditures of the City for the next
year.

Mr. Nickerson further noted that Sections 2 and 3 of the proposed ordinance adopts, assess and
levies the tax rate for General Fund Maintenance and Operations; and Sections 4 and 5 of the
proposed ordinance adopts, assessed and levies the tax rate for debt service. The proposed tax
rate of $0.46093 per $100 valuation for maintenance and operations together with the proposed
tax rate of $0.34110per $100 valuation for debt service exceeds the effective tax rate or the
rollback rate. Mr. Nickerson clarified that the City's property tax rate is actually going down one
penny from prior year, or from .81203 to .80203, and while according to state law, the City is
required to say that this is an increase in the effective tax rate because more revenue is set to be
collected in the upcoming year than in the prior year, the City tax rate is in fact going to be lower
than in the previous year.
A motion was made by Council Member Heather Betancourth, and seconded by Council
Member Chris Presley to approve Ordinance No. 14,219 related to Item La. The vote was as
follows:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, ADOPTING THE RATE AND TAX LEVY FOR GENERAL FUND
MAINTENANCE AND OPERATIONS AND DEBT SERVICE FOR THE CITY
OF BAYTOWN FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 2020,
UPON ALL TAXABLE PROPERTY IN SAID CITY OF BAYTOWN IN
ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS AND THE
CHARTER PROVISIONS AND ORDINANCES OF SAID CITY; PROVIDING
A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
b. Consider an ordinance authorizing the sole source purchase and installation of the
-Ninja Cross" attraction at Pirates Bay Water Park from Progressive Commercial
Aquatics, Inc.
A motion was made by Mayor Pro Tem Robert C. Hoskins, and seconded by Council Member
Chris Presley to approve Ordinance No. 14,220 related to Item Lb. The vote was as follows:

TEXAS, AUTHORIZING THE PAYMENT OF THE SUM OF TWO
HUNDRED FIFTY-SEVEN THOUSAND FIVE HUNDRED AND NOI100
DOLLARS ($257,500.00) TO PROGRESSIVE COMMERCIAL AQUATICS,
INC., FOR THE SOLE -SOURCE PURCHASE AND INSTALLATION OF
THE "NINJA CROSS" ATTRACTION FOR PIRATES BAY WATER PARK;
MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.
Mayor Capetillo asked for a motion to recess the City Council October 3, 2019, Special
Meeting until after the completion of the Baytown Hospitality Public Facilities
Corporation meeting.

WITH THE CONSTRUCTION, DEVELOPMENT, AND FINANCING OF THE
PROPOSED BAYTOWN HOTEL AND CONVENTION CENTER PROJECT;
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
