ORDINANCE NO. 8911
® AN ORDINANCE ACCEPTING THE BID OF DAVID H. DICKERSON IN THE
AMOUNT OF FIVE HUNDRED AND NO /100 DOLLARS ($500.00) FOR THE SALE
OF PROPERTY LOCATED AT THE CORNER OF CEDAR BAYOU - LYNCHBURG
AND FOREST TRAIL, BAYTOWN, HARRIS COUNTY, TEXAS; AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, the City of Baytown, Texas, sought competitive bids for the sale of property located
at the corner of Cedar Bayou - Lynchburg and Forest Trail, Baytown, Harris County, Texas (the
"Property"); and
WHEREAS, an opportunity for open competition was given pursuant to the provisions of Section
73 of the Charter of the City of Baytown; and
WHEREAS, all bids were opened and publicly read at City Hall at 2:00 p.m., Thursday, May 4,
2000; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby accepts the bid of David H.
Dickerson in the amount of FIVE HUNDRED AND N01100 DOLLARS ($500.00) for the sale of
property located at the corner of Cedar Bayou - Lynchburg and Forest Trail, Baytown, Harris County,
Texas, which amount is in excess of the market value of the Property.
Section 2: That the Mayor of the City of Baytown, Texas, is hereby authorized and directed
to execute the Deed Without Warranty for the sale of the aforementioned property. A copy of said Deed
Without Warranty is attached hereto, marked Exhibit "A," and made a part hereof for all intents and
purposes.
Section 3: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of
Baytown this the l Vh day of May, 2000.

THAT GRANTOR, CITY OF BAYTOWN, TEXAS, a municipal corporation located in
Harris and Chambers County, Texas, for and in consideration of the sum of FIVE HUNDRED
AND NO /100 DOLLARS ($500.00) and other good and valuable consideration paid by the
GRANTEE named in this instrument, the receipt and sufficiency of which are acknowledged by
GRANTOR, has GRANTED, SOLD and CONVEYED, and by these presents does GRANT,
SELL, and CONVEY to DAVID H. DICKERSON, the following described property:
BEING out of Lot 21, Block 2 of Cedar Bayou Estates, according to.the recorded map of
Cedar Bayou Estates filed under Harris County Clerk's File No. 556786, being also a
part of that certain parcel of land conveyed to Perry Walker by deed recorded on
May 28, 1976, and filed under Harris County Clerk's File No. 777311, and being more
particularly described as follows:
COMMENCING at the Southeast corner of said Lot 21;
THENCE South 800 30' West with the North right -of -way line of said Lynchburg
Road a distance of 71.80 feet to the POINT OF BEGINNING of the herein
described tract;
THENCE North 150 19' 35" East a distance of 69.42 feet;
THENCE South 800 30' West a distance of 96.25 feet;
THENCE South 090 30' East a distance of 63.00 feet;
THENCE North 800 30' East with the Nort h right -of -way line of Lynchburg Road
a distance of 67.10 feet to the POINT OF BEGINNING, enclosing a tract of land
containing 0.1181 acres, more or less.
GRANTOR excludes and excepts any warranties, express or implied, regarding the
® above- described property, including, without limitation, any warranties arising by common law
or Section 5.023 of the Property Code or its successor.

EXHIBIT A
® TO HAVE AND TO HOLD the above - described property, together with all and singular
the rights and appurtenances belonging in any way to said property, subject to the provisions
stated above, to GRANTEE forever, without warranty of any kind.
