Ordinance No. 8,85520000309 -04 ORDINANCE NO. 8855 ® AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ORDERING A SPECIAL ELECTION TO BE HELD ON THE 6TH DAY OF MAY, 2000, FOR THE PURPOSE OF VOTING FOR. OR AGAINST THE ADOPTION OF THE STATE LAW APPLICABLE TO FIRE FIGHTERS THAT ESTABLISHES COLLECTIVE BARGAINING; PROVIDING FOR THE ELECTION OFFICERS; DESIGNATING THE PLACES AND MANNER OF HOLDING SAID ELECTION; PRESCRIBING THE HOURS; ESTABLISHING THE CENTRAL COUNTING STATION; PROVIDING FOR AN EARLY BALLOT BOARD FOR EARLY BALLOTS; AND PROVIDING FOR THE POSTING AND PUBLICATION OF NOTICE. WHEREAS, since the passage of Ordinance No. 8812 calling the 2000 municipal election for the purpose of electing the following members of the City Council: Mayor, Councilmember from District No. Four, Councilmember from District No. Five, and Councilmember from District No. Six, a petition was tendered to the City Clerk for the purpose of submitting to the voters the question of collective bargaining for the fire fighters of the City of Baytown; and WHEREAS, the City Clerk has verified the petition as containing signatures of at least 5% of the voters voting in the City during the last general election for state and county officials; and WHEREAS, the City Council herein calls a special election to be held on the 6th day of May, 2000, for the purposes of voting for or against the adoption of the state law applicable to fire fighters that establishes collective bargaining; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the special election, pursuant to Sections 41.001 and 41.031 of the Texas Election Code, shall be held between the hours of seven o'clock a.m. and seven o'clock p.m. on the 6th day of May, 2000, in the City of Baytown, Texas for the purpose of considering the the adoption of the state law applicable to fire fighters that (i) establishes collective bargaining if a majority of the affected employees favor representation by an employees association, (ii) preserves the prohibition against strikes and lockouts, and (iii) provides for penalties for strikes and lockouts, as prescribed in Chapter 174 of the Texas Local Government Code. In all City elections, the Mayor and the City Clerk of the City Council shall do and perform each act as required to be done and performed respectively by the County Judge and the County Clerk of the Commissioners' Court. The notice of proclamation of this election shall be issued and posted on the bulletin board used for posting notices of meetings not later than the twenty -first (21St) day before the date of the election ordered herein. Section 4: That the adoption of Chapter 174 of the Texas Local Government Code shall be presented to City at large; and if a majority of the votes cast at the special election favor adoption of such chapter, the City Council of the City of Baytown shall place such chapter in effect not later than the 30th day after the beginning of the first fiscal year of the City of Baytown after the special election. Section 5: That the form of the ballot for said election shall be substantially as follows: OFFICIAL BALLOT FOR OR AGAINST Adoption of the state law applicable to fire fighters that establishes collective bargaining if a majority of the affected employees favor representation by an employees association, preserves the prohibition against strikes and lockouts, and provides penalties for strikes and lockouts. Section 6: Each qualified voter who desires to cast an early vote shall be entitled to an official ballot and the right to cast such ballot in accordance with the provisions of the Texas Election Code. I Section 7: The City Council Chamber and Conference Room area of the City Hall of the City of Baytown, located at 2401 Market Street, are hereby established as the Central Counting Station to receive and tabulate voted ballots. The City Clerk is hereby appointed Manager of the Central Counting Station and also Tabulation Supervisor. Nestor Moreno is hereby appointed Presiding Judge for the Central Counting Station. Section 8: There is hereby created an Early Voting Ballot Board which shall process early voting results. Sandra Northcutt is hereby appointed Presiding Judge of the Early Voting Ballot Board. Section 9: The Mayor is hereby directed to give notice of said election by publishing a copy of the Election Proclamation and Notice in a newspaper of general circulation within the City of Baytown, Texas; said publication to be made no earlier than the 30th day or later than the tenth day prior to the date of said election. Section 10: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown, Texas.
