AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY
LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF ALL
PROPERTY CURRENTLY WITHIN THE EXTRATERRITORIAL JURISDICTION OF
THE CITY OF BAYTOWN BETWEEN GARTH ROAD ON THE EAST, BUSH ROAD
ON THE WEST, WEST. LYNCHBURG CEDAR BAYOU ROAD (ALSO KNOWN AS
CEDAR BAYOU LYNCHBURG ROAD) ON THE NORTH AND BAKER ROAD ON
THE SOUTH, SAVE AND EXCEPT THE 18.59 ACRE TRACT CURRENTLY IN THE
ANNEXATION PROCESS AND INCLUDING THE AREA BETWEEN GINGER CREEK
AND BUSH ROAD THAT IS BOUNDED BY GINGER CREEK ON THE WEST, BUSH
ROAD ON THE EAST, QUAIL HOLLOW ON THE SOUTH AND WEST LYNCHBURG
CEDAR BAYOU ROAD ON THE NORTH; WHICH SAID TERRITORIES LIE
ADJACENT TO AND ADJOIN THE PRESENT BOUNDARY LIMITS FOR THE CITY
OF BAYTOWN, TEXAS.

WHEREAS, there being no request for an "on- site" hearing, two public hearings before the City
Council of the City of Baytown, Texas, where all interested, persons were provided with an opportunity to be
heard on the proposed annexation of the property described in Section 1 of this ordinance, were held, one at
6:35 p.m. and the other at 6:40 p.m., on the 10t" day of February, 2000, in the City Council Chamber of the
City Hall of the City of Baytown, Texas, which date is not more than forty (40) nor less than twenty (20) days
prior to the institution of annexation proceedings; and
WHEREAS, notices of such public hearings were published in a newspaper having general circulation
in the City of Baytown, Texas, and in the below described territories on the 28"' day of January, 2000, which
date is not more than twenty (20) nor less than ten (10) days prior to the date. of such public hearings; and
WHEREAS, the total corporate area of the City of Baytown, Texas, on the 1 st day of January, 2000,
was 32.70 square miles; and
WHEREAS, the population of the City of Baytown, Texas, is approximately 68,466 inhabitants; and
WHEREAS, the below described territories lie within the extraterritorial jurisdiction of the City of
Baytown, Texas; and
WHEREAS, the below described territories lie adjacent to and adjoin the City of Baytown, Texas;
NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the following described land and territories lying adjacent to and adjoining the
City of Baytown are hereby added and annexed to the City of Baytown, Texas, and
shall hereinafter be included within the boundary limits of the City of Baytown, Texas, and present boundary
limits of such City, at the various points contiguous to the areas hereinafter described, are altered and amended
so as to include said areas within the corporate limits of the City of Baytown, Texas, to -wit:

Section 2: The above described territories and the areas so annexed shall be a part of the City
of Baytown, Texas, and the property so added hereby shall bear its pro rata of the taxes levied by the City of

® Baytown, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens
of the City of Baytown and shall be bound by the acts, ordinances, resolutions, and regulations of the City of
Baytown, Texas.
Section 3: In accordance with Texas Local Government Code Annotated § 43.056, as amended,
the service plan prepared by the City for providing municipal services to the annexed areas is attached as
Exhibit "B" and is hereby approved.
Section 4: This ordinance shall be published and passed in the manner provided in Article 1,
Section 9, of the Charter of the City of Baytown, Texas.

Being a 275.898 acre tract or parcel of land situated in and being a portion of the T.T.
Ristergen Survey, Abstract No. 1425, also known as the W.0 RR Co. No. 2 Survey, the
Harvey Whiting League, Abstract No. 840, and the John McBean Survey, Abstract No. 1017,
also known as the G.C. & S.F. RR No. l Survey, and also being a portion of Block 129 of
Elena Fruit and Cotton Farms, Unit "D ", according to the map or plat thereof recorded in

SUMMARY
This proposed Annexation is located in the ETJ, bounded by Garth Road on the east,
Bush Road on the west, Lynchburg -Cedar Bayou on the north, and Baker Road on the
south; save and except the 18.59 -cre tract recently annexed. This proposed annexation
includes Country Club Cove Subdivision, an approximately 49.72 -care tract consisting of
184 lots. The area to be annexed also includes land bounded by Ginger Creek on the
west, Bush Road on the east, Quail Hollow on the'south and Lynchburg -Cedar Bayou on
the north.
Size of Area: The area proposed for annexation is approximately 269.24 acres shown on
the attached map.
Proposed Land Use: Residential. Upon annexation,_the property will be in the Mixed Use
(MU) zoning district.
Impact: As a result of this proposed annexation, no additional city facilities, vehicles, or
personnel will be required. For fire protection purposes, the project site will be assigned
to Fire Station 1 and Police District 2.
Means of Accomplishment: The annexation will be accomplished from the existing city
limit line.
Public Input: Public Hearings will be held to allow for public input.

Traffic Control Operations
This proposed annexation includes two problematic intersections that will
now be the responsibility of the city for maintenance and within the purview
of the city for improvements to address traffic problems that already exist
and will only grow with further development in the area. These are the
intersections of Bush Rd. with Stonehedge Dr. and with Lynchburg -Cedar
Bayou Rd..
The intersection of Bush Rd. with Lynchburg -Cedar Bayou Rd. probably
already meets traffic control signal installation warrant criteria (if it doesn't
now, it will soon with added development and therefore added traffic
volumes in this area). The signalization of this intersection when required
will result in an installation cost of approximately $50,000 and annual
operating costs in the range of $2,500 per year. Being within the city, this
cost will accrue to the city.
The intersection of Bush Rd. with Stonehedge Dr. was impacted by the
widening of Bush Rd., resulting in the nearness of the Bush Rd. paving to
the right -of -way line and adjacent residential fencing. No good solution to
the situation has been formed to this time and this annexation will present
the city with this problem to be solved.

1. The area to be annexed is approximately 269.24 acres bounded by Garth Road on
