Ordinance No. 8,85120000224 -12 ORDINANCE NO. 8851 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, TERMINATING THE SUBSCRIPTION AGREEMENT WITH E- COURT, INC., CONCERNING THE PAYMENT OF TRAFFIC TICKETS AND OTHER FINES; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ****************************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** WHEREAS, on September 23, 1999, the City Council of the City of Baytown, Texas, authorized a subscription agreement with E -Court, Inc. (the "Agreement "); and WHEREAS, pursuant to the Agreement, E -Court was to maintain a Web Site accessible over the Internet for payment of traffic tickets and other fines; and WHEREAS, to date, E -Court, Inc., has failed to perform any service or install any equipment in furtherance of its obligations under the Agreement; and WHEREAS, the Agreement authorizes the City to terminate the Agreement at any time without a cancellation fee; and WHEREAS, the City Council of the City of Baytown desires to terminate the Agreement pursuant to its terms; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: All matters and facts set forth in the recitals above are found to be true and are approved as the findings of the City Council of the City of Baytown. Section 2: That the City Council of the City of Baytown, Texas, hereby exercises it option and privilege to terminate the subscription agreement between the City of Baytown and E -Court, Inc., authorized by the City Council of the City of Baytown on the 23`d day of September, 1999, concerning the payment of traffic tickets and other fines. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
