ORDINANCE NO. 8846
® AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER
AND THE CITY CLERK OF THE CITY OF BAYTOWN TO EXECUTE AND
ATTEST TO A CONTRACT WITH THE TEXAS DEPARTMENT OF
TRANSPORTATION FOR SUPPLEMENTAL FUNDING FOR PHASE III OF
THE GOOSE CREEK STREAM GREENBELT TRAIL; AND PROVIDING FOR
THE EFFECTIVE DATE THEREOF.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes and
directs the City Manager and the City Clerk of the City of Baytown to execute and attest to a contract
with Texas Department of Transportation for supplemental funding for Phase III of the Goose Creek
Stream Greenbelt Trail. A copy of said contract is attached hereto, marked Exhibit "A," and made
a part hereof for all intents and purposes.
Section 2: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City
of Baytown this the 24th day of February, 2000.

(SURFACE TRANSPORTATION PROGRAM CATEGORY 4B
TRANSPORTATION ENHANCEMENTS AND CATEGORY 5 CONGESTION
MITIGATION AND AIR QUALITY)
THIS AMENDMENT, is made by and between the State of Texas, acting by and through the
Texas Department of Transportation, hereinafter called the "State" and the City of Baytown,
Texas, hereinafter called the "City".
WHEREAS, the State and the City executed an agreement on the 15th day of February 1995
concerning the construction of an multipurpose bicycle /pedestrian facility with landscaping and
historic preservation from SH 146 to Decker Drive along Goose Creek in Baytown; and
WHEREAS, the portion of the project from SH 146 to the end of Arizona Street (Phase I) has
been let to contract by the State and. construction has been completed; and
WHEREAS, the cost of the Phase 2 project from the end of Arizona Street to Decker Drive has
increased significantly from the original nomination and there are no additional Enhancement
Program funds available for the project; and
WHEREAS, Title 23 U.S.C. Section 149 establishes the Congestion Mitigation and Air Quality
Improvement Program ( "CMAQ ") to contribute to attainment of the national ambient air quality
standard to be implemented by the State's Transportation Agencies; and
WHEREAS, Houston is classified as a severe ozone non - attainment area, and the State must use
® funds in ozone and carbon monoxide non - attainment areas; and

WHEREAS, Title 23 U.S.C. Section 120 establishes that the federal share of funding for
® Congestion Mitigation and Air Quality Programs will not exceed eighty percent (80 %) of the
Project cost; and

WHEREAS, the Project has been approved by the Federal Highway Administration and the
Texas Transportation Commission for additional funding under the Congestion Mitigation and
Air Quality Program as indicated in the 2000 -2002 Transportation Improvement Program, a page
of which is attached hereto and identified as "Exhibit A "; and
WHEREAS, the original enhancement project is also shown in the 2000 -2002 Transportation
Improvement Program a page of which is attached hereto and identified as "Exhibit B "; and
WHEREAS, these changes necessitate the amendment of the agreement; and
NOW THEREFORE, it is agreed to amend certain segments of the Baytown Goose Creek
Bikeway project funding agreement as follows:
SECTION 5 PARAGRAPH A AND B
These sections shall be voided in their entirety and replaced with the following:
5. FUNDING RESPONSIBILITIES
A. The estimated total cost of all phases of the Project, including construction engineering
and testing services, is $2,210,750. Congestion Mitigation and Air Quality funding will
total $806,250 and Enhancement funding will total $1,404,500.
B. The State will be responsible to secure the federal share of funding required for the
development and construction of all phases of the Project. The federal share for the
development and construction of all phases of the Project is eighty percent (80 %) of the
total estimated cost of all phases of the Project, not to exceed $1,768,600. The Federal
portion of the Congestion Mitigation and Air Quality funding will total $645,000 and
Enhancement funding will total $1,123,600. The City will be responsible to comply with
the cost principles established in OMB Circular A -87, "Cost Principles for State and Local
Governments" and for any non - federal participation costs associated with all phases of the
Project.

This section shall be voided in its entirety and replaced with the following:

14. INSPECTION OF CITY'S BOOKS AND RECORDS
The parties will, for purpose of termination of the agreement prior to completion,
examine the books and records of the other party for the purpose of checking the amount
of the work performed at the time of contract termination. The parties shall maintain all
books, documents, papers, accounting records and other documentation relating to costs
incurred under this agreement and other documentation relating to costs incurred under
this agreement and shall make such materials available to the City, State, Federal
Highway Administration (FHWA) or their duly authorized representatives for four (4)
years from the date of final payment under this contract or until impending litigation is
resolved. Additionally, the City, State, FHWA, and their duly authorized representatives
shall have access to all records of the parties which are directly applicable to this
agreement for the purpose of making audits, examinations, excerpts, and transcriptions.
SECTION 15
This section shall be voided in its entirety and replaced with the following:
15. OMB A -133 AUDIT REQUIREMENTS
The City shall comply with the requirements of the Single Audit Act of 1984, P.L. 98-
502, ensuring that the single audit report includes the coverage stipulated in OMB
Circular No. A -133.
All other terms and conditions of the contract are unchanged and remain in full force and effect.

duplicate counterparts.
