ORDINANCE NO. 8746
® AN ORDINANCE ACCEPTING THE BID OF NORMAN W. DYKES IN THE
AMOUNT OF SEVEN THOUSAND SIX HUNDRED TEN AND NO /100 DOLLARS
($7,610.00) FOR THE SALE OF APPROXIMATELY ONE QUARTER (1/4) ACRE
(0.2455) LOCATED ADJACENT TO THE LANDING AT CEDAR BAYOU,
SECTION ONE, BAYTOWN, CHAMBERS COUNTY, TEXAS; AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, the City of Baytown, Texas, sought competitive bids for the sale of approximately
one quarter (1/4) acre (0.2455) located adjacent to The Landing at Cedar Bayou, Section One, Baytown,
Chambers County, Texas (the "Property"); and
WHEREAS, an opportunity for open competition was given pursuant to the provisions of Section
73 of the Charter of the City of Baytown; and
WHEREAS, all bids were opened and publicly read at City Hall at 2:00 p.m., Thursday,
October 21, 1999; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby accepts the bid of
Norman W. Dykes in the amount of SEVEN THOUSAND SIX HUNDRED TEN AND NO /100
DOLLARS ($7,610.00) for the sale of approximately one quarter (1/4) acre (0.2455) located adjacent to
The Landing at Cedar Bayou, Section One, Baytown, Chambers County, Texas, which amount is in
excess of the market value of the Property.
Section 2: That the Mayor of the City of Baytown, Texas, is hereby authorized and directed
to execute the Deed Without Warranty for the sale of the aforementioned property. A copy of said Deed
Without Warranty is attached hereto, marked Exhibit "A," and made a part hereof for all intents and
purposes.
Section 3: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of
Baytown this the 28th day of October, 1999.

Harris and Chambers County, Texas, for and in consideration of the sum of SEVEN
THOUSAND SIX HUNDRED TEN AND NO /100 DOLLARS ($7,610.00) and other good and
valuable consideration paid by the GRANTEE named in this instrument, the receipt and
sufficiency of which are acknowledged by GRANTOR, has GRANTED, SOLD and
CONVEYED, and by these presents does GRANT, SELL, and CONVEY to NORMAN W.
DYKES, the following described property:
See Exhibit "A"
GRANTOR excludes and excepts any warranties, express or implied, regarding the
above- described property, including, without limitation, any warranties arising by common law
or Section 5.023 of the Property Code or its successor.
TO HAVE AND TO HOLD the above- described property, together with all and singular
the rights and appurtenances belonging in any way to said property, subject to the provisions
stated above, to GRANTEE forever, without warranty of any kind.

Survey, Abstract Number 2, Chambers County, Texas, and being out of and a part of a 0.30 of an acre
tract of land conveyed to the City of Baytown by Texas Trust Savings Bank by deed dated November 15,
1990, and recorded in Volume 132 at Page 646 of the Official Public Records of Chambers County,
Texas. This 0.2455 of acre tract of land is more particularly described by metes and bounds as follows,
to -wit:
NOTE: BEARINGS ARE BASED ON PLAT BEARINGS AND FOUND MONUMENTS IN THE
SOUTH LINE OF THE LANDING AT CEDAR BAYOU ACCORDING TO RECORDED PLAT IN
VOLUME `B" AT PAGE 88 OF THE MAP RECORDS OF CHAMBERS COUNTY, TEXAS.
REFERENCE IS MADE TO PLAT OF EVEN DATE ACCOMPANYING THIS METES AND
BOUNDS DESCRIPTION.
CONCVIENCING at a 5/8 inch iron rod found for an interior comer of the residue of a 16.66 acre tract of
land conveyed to Norman W. Dykes, by Texas Trust Savings Bank by deed dated December 2, 1993, and
recorded in Volume 238 at Page 142 of the Official Public Records of Chambers County, Texas, and the
Southeast corner of Lot 9 of block 1 of The Landing at Cedar Bayou.
THENCE North 06 °48'29" East with the most Easterly West line of said residue of 16.66 acres, and the
East line of said Lot 9 a distance of 46.50 feet to a 5/8 inch iron rod found for the Northeast corner of
said Lot 9, the Southeast corner of Lot 8, the most Southerly Southwest corner of said 0.30 of an acre
tract, and the Southwest and BEGINNING corner of this tract of land.
THENCE North 06 04829" East with the most Easterly West line of said residue of 16.66 acres, and the
East line of said Lot 8 and Lot 7 a distance of 93.00 feet to a %: inch iron rod set for the Northwest corner
of this tract of land, the Northeast corner of said Lot 7, and the Southeast comer of Lot. 6 in the North
