"BOND; INSURANCE," SUBSECTION (B) "INSURANCE POLICY
REQUIREMENTS," OF THE CODE OF ORDINANCES, CITY OF
BAYTOWN, TEXAS, TO ELIMINATE THE REQUIREMENT TO NAME THE
CITY AS AN ADDITIONAL INSURED AND ELIMINATE THE
REQUIREMENT OF A POSITIVE AFFIRMATION OF NOTICE OF
CANCELLATION AND REPLACE SUCH NOTICE WITH AN ENDEAVOR
TO NOTICE STANDARD; PROVIDING A REPEALING CLAUSE;
CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Chapter 18 "Buildings and Building Regulations," Article III
"Electrical Code," Division 4 "Permits and Inspections," Section 18 -263 "Insurance required of
master electricians for permit issuance," Subsection (b) of the Code of Ordinances, City of
Baytown, Texas, is hereby amended to read as follows:
Chapter 18. BUILDINGS AND BUILDING REGULATIONS
ARTICLE III. ELECTRICAL CODE
DIVISION 4. PERMITS AND INSPECTIONS
Sec. 18 -263. Insurance required of master electricians for permit issuance.
(b) Such insurance shall be written by an insurance carrier licensed to do business in this
state and shall provide that coverages afforded under the policy will not be canceled, suspended,
® voided or reduced until at least 30 days' prior written notice has been endeavored to be given to
the city via certified mail, return receipt requested.

master sign electricians for permit issuance," Subsection (b) of the Code of Ordinances, City of
Baytown, Texas, is hereby amended to read as follows:

be given to the city via certified mail, return receipt requested.
Section 3: That Chapter 18 'Buildings and Building Regulations," Article IV
"Plumbing Code," Section 18 -465 "Insurance required before permit issuance, "Subsection (b) of
the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows:

(b) Such insurance shall be written by an insurance carrier licensed to do business in
this state and shall provide that coverages afforded under the policy will not be canceled,
suspended, voided or reduced until at least 30 days' prior written notice has been endeavored to
be given to the city via certified mail, return receipt requested.
Section 4: That Chapter 18 'Buildings and Building Regulations," Article V
"Mechanical Code," Division 4 "Licenses and Permits," Section 18 -591 "Insurance
requirements," Subsection (a)(3) of the Code of Ordinances, City of Baytown, Texas, is hereby
amended to read as follows:

Sec. 18 -591. Insurance requirements.
(a)(3) Evidence of compliance with the insurance requirements of this subsection shall
be considered as having been met when the policy, a copy thereof, or a certificate of insurance
has been filed with and approved by the mechanical inspector or chief building official. Such
policy shall include an endorsement thereon that at least 45 days' prior written notice will be
endeavored to be given to the mechanical board if the policy is cancelled or expires before the
expiration date of the license and at least ten days after nonrenewal or cancellation by the
insured.
Section 5: That Chapter 18 "Buildings and Building Regulations," Article VIII
"House Leveling," Division 2 "Permit and Inspections," Section 18 -942 "Insurance," Subsection
(b) of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows:

Sec. 18 -942. Insurance.
(b) Such insurance shall be written by an insurance carrier licensed to do business in
this state and shall provide that coverages afforded under the policy will not be canceled,
suspended, voided or reduced until at least 30 days' prior written notice has been endeavored to
be given to the city via certified mail, return receipt requested
Section 6: That Chapter 118 "Signs," Article II "Administration," Division 4
"Permits," Section 118 -130 'Bond; insurance," Subsection (b) of the Code of Ordinances, City of
Baytown, is hereby amended to read as follows:

ARTICLE II. ADMINISTRATION
DIVISION 4. PERMITS
Sec. 118 -130. Bond; insurance.
(b) Insurance policy requirements. Such insurance shall be written by an insurance
carrier licensed to do business in this state and shall provide that coverages afforded under the
policy will not be canceled, suspended, voided or reduced until at least 30 days' prior written
notice has been endeavored to be given to the city via certified mail, return receipt requested
Section 7: All ordinances or parts of ordinances inconsistent with the terms.of this
ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of

such inconsistency and in all other respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter covered by this ordinance.
Section 8: If any provisions,, section, exception, subsection, paragraph, sentence,
clause or phrase of this ordinance or the application of same to any person or set of
circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall
not affect the validity of the remaining provisions of this ordinance or their application to other
persons or sets of circumstances and to this end all provisions of this ordinance are declared to be
severable.
Section 9: This ordinance shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
