ORDINANCE NO. 8703
AN ORDINANCE OF THE CITY COUNCIL, OF THE CITY OF BAYTOWN, TEXAS,
GRANTING A WAIVER TO THE PROGRAM LIMITS FOR THE HOUSING
REHABILITATION PROGRAM FOR COMMUNITY DEVELOPMENT
REHABILITATION PROJECT NO. 99 -06, THE RECONSTRUCTION OF THE
STRUCTURE LOCATED AT 1108 TURNER STREET; AWARDING THE CONTRACT
FOR COMMUNITY DEVELOPMENT REHABILITATION PROJECT NO. 99 -06 TO
COLTS DEVELOPMENT, INC., FOR THE SUM OF THIRTY -SEVEN THOUSAND
AND NO /100 DOLLARS ($37,000.00); AUTHORIZING PAYMENT THEREOF;
MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.

WHEREAS, the home located at 1108 Turner has deteriorated to a very poor condition; and
WHEREAS, the owners of such structure have qualified as being eligible for the City of Baytown's
Housing Rehabilitation Program; and
WHEREAS, the owners of the property have signed a waiver to allow the City of Baytown to
demolish the existing house and reconstruct a smaller house on the property in accordance with such
program; and
WHEREAS, the reconstruction of the home was advertised for bid; however, all three contractors
who bid on the project indicated that the program limit of $27,000 was not sufficient to build the house to
the requisite standards of the City of Baytown; and
WHEREAS, the City of Baytown then decided to rehabilitate the house in two stages — the first
being the foundation work then the rest of the rehabilitation work; and
WHEREAS, the foundation work was bid out twice before the City was able to obtain a contractor
to perform the work; and
WHEREAS, the contractor, to whom the contract was let, did not perform the work as required by
the contract and, thus, the City gave notice to terminate and has terminated the contract; and
(
WHEREAS, based upon the above- described events, the City Council of the City of Baytown now
desires to reconstruct a smaller home at 1108 Turner, Baytown, Harris County, Texas; and
WHEREAS, the City Council of the City of Baytown understands and agrees in order to do so the
limits of the City of Baytown's Housing Rehabilitation Program must be raised for this project; and
WHEREAS, the City of Baytown desires to raise such limits for this project up to an amount of
FORTY -THREE THOUSAND AND NO/ 100 DOLLARS ($43,000.00); and
WHEREAS, the City Council of the City of Baytown, Texas, hereby grants a waiver to the program
limits and authorizes the expenditure as indicated herein for the reconstruction of a smaller, code - compliant
home at 1108 Turner Street, Baytown, Harris County, Texas, under the City of Baytown's Housing
® Rehabilitation Program; and

® WHEREAS, the City of Baytown did advertise for bids for City of Baytown's Rehabilitation Project
No. 99 -06 to be received September 16, 1999; and
WHEREAS, notice to all bidders as to the time and place, when and where the contract would be let
was published pursuant to provisions of Chapter 252 of the Texas Local Government Code and applicable
resolutions of the City of Baytown; and
WHEREAS, all bids were opened and publicly read at the Community Development Office at 10:00
a.m., Friday, September 17, 1999, as per published notice to bidders; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby waives the program
limit of $27,000 specified in the City of Baytown's Community Development Housing Rehabilitation
Program for Rehabilitation Project No. 99 -06 only. For this project, the City Council raises said limit to the
sum enumerated in Section 2 hereof.
Section 2: That the City Council of the City of Baytown hereby accepts the bid of Colts
Development, Inc., for the sum of THIRTY -SEVEN THOUSAND AND NO /100 DOLLARS ($37,000.00)
for the City of Baytown's Community Development Rehabilitation Project No. 99 -06 being the repair and
rehabilitation of 1108 Turner Street, Baytown, Texas, and authorizes payment thereof, providing that final
payment will not be made to said contractor until completion and acceptance of the work by the owner and
the Baytown Community Development Program.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of
