Ordinance No. 14,283ORDINANCE NO. 14,283 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AWARDING THE ANNUAL FIRE UNIFORM CONTRACT TO GALLS, LLC, F/K/A RED THE UNIFORM TAILOR, THROUGH A COOPERATIVE AGREEMENT WITH THE CITY OF FRISCO, FOR THE PURCHASE OF FIRE UNIFORMS; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN OF AN AMOUNT NOT TO EXCEED ONE HUNDRED FIVE THOUSAND AND N0.100 DOLLARS ($105,000.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ******************************************************************************************** WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement for cooperative purchasing with the City of Frisco; and WHEREAS, pursuant to such agreement, the City may make purchases based upon the bids received by the City of Frisco; and WHEREAS, the City of Frisco has taken bids for fire uniforms for the Fire Department; and WHEREAS, the City of Baytown, in making a purchase under a cooperative purchasing agreement, satisfies state law requiring municipalities to seek competitive bids for the purchase of the items; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby awards the Annual Fire Uniform Contract to Galls, LLC, f/k/a Red the Uniform Tailor, through a cooperative agreement with the City of Frisco, for the purchase of fire uniforms, in an amount not to exceed ONE HUNDRED FIVE THOUSAND AND NO:: 100 DOLLARS ($105,000.00) and authorizes payment thereof. Section 2: That pursuant to the provisions of Texas Local Government Code Annotated §252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO.100 DOLLARS ($50,000.00) or less, provided that the original contract price of each item specified in Section 1 hereof may not be increased by more than twenty-five percent (25 %) or decreased by more than twenty-five percent (250.6) without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
