Ordinance No. 14,267ORDINANCE NO. 14,267 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, OPTING OUT OF THE CONTINUED RECEIPT OF ITS SHARE OF BINGO PRIZE FEE FUNDS FOR BINGO GAMES CONDUCTED IN THE CORPORATE LIMITS OF THE CITY OF BAYTOWN; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. *************************************************************************************** WHEREAS, the City of Baytown was entitled to receive a portion of bingo prizes fee for bingo games conducted in the City as of January 1, 2019; and WHEREAS, House Bill 914 provides that if the City of Baytown desires to impose the prize fee for bingo games conducted in the City after January 1, 2020, the City Council of the City of Baytown must vote to impose such fee before November 1, 2019; and WHEREAS, on October 24, 2019, the City Council via Ordinance No. 14,223 approved the continued receipt of its share of bingo prize fee funds and imposed such fee for bingo games conducted in the corporate limits of the City of Baytown; and WHEREAS, the City Council wants its share of the prize fees to remain with the non-profit organizations conducting the charitable bingo activities and, therefore, wishes to discontinue its right to receive the prize fee funds; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That all matters and facts set forth in the recitals hereinabove are found to be true and are approved by the City Council of the City of Baytown, Texas. Section 2: That the City Council of the City of Baytown, Texas, hereby opts out of the receipt of its share of bingo prize fee funds for bingo games conducted in the corporate limits of the City of Baytown. Section 3: That the City Clerk is hereby directed to notify (a) the Texas Lottery Commission ("TLC") of the passage of this ordinance by sending the TLC a certified copy of the same, and (b) each licensed authorized organization within the corporate limits of the City of Baytown of the City's decision to opt out of the continued imposition of the fee. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
