Ordinance No. 8,662990826 -3 ORDINANCE NO. 8662 ® AN ORDINANCE AUTHORIZING THE CITY MANAGER TO TERMINATE ANY AND ALL OUTSTANDING CONTRACTS AND OTHER OBLIGATIONS OF SAN JACINTO PLACE MUNICIPAL UTILITY DISTRICT NOS. 1, 2, 3, AND 4; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City of Baytown annexed all of the area in San Jacinto Place Municipal Utility District Nos. 1, 2, 3 and 4 (collectively referred to as the "MUDs ") on August 26, 1999; and WHEREAS, potentially, the MUDs have outstanding contracts with the following entities: Lone Star Bank Bldg., Ltd. Construction & purchase of utility facilities Pacer Development Reimbursement of legal, engineering, publication, insurance and other miscellaneous expenses Busch Hutchinson & Assoc., Inc. Engineering Services Coats, Rose, Yale, Ryman & Lee Bond and General Counsel Services Mvrtle Cruz. Inc. Bookkeeping Services Bob Leared Interest Tax Assessing /Collecting Services (Abacus Computer) WHEREAS, the City Council of the City of Baytown finds that it is in the best interest of the City of Baytown to terminate each of outstanding contracts of the MUDS, NOW THEREFORE., BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section l: That the City Council of the City of Baytown hereby authorizes the City Manager to terminate any and all outstanding contracts and other obligations of San Jacinto Place Municipal Utility District Nos. 1, 2, 3, and 4. Section 2: 1 All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or the set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of the ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council.
