Ordinance No. 8,594990527 -6 ORDINANCE NO. 8594 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING PAYMENT IN AN AMOUNT NOT TO EXCEED TWENTY -FIVE THOUSAND AND NO/] 00 DOLLARS ($25,000.00) TO TANDEM, INC., FOR THE REMOVAL AND PROCESSING OF BRUSH, LIMBS AND TREES; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the storm of May 10, 1999, caused an accumulation of brush, limbs and trees throughout the City of Baytown (the "City"); and WHEREAS, this accumulation of brush, limbs and trees has created health and safety conditions that must be eliminated in order to provide for the safety and welfare of the citizens of the City; and WHEREAS, Texas Local Government Code Annotated § 252.022, provides that in case of procurements for the protection of public health or safety, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the removal and processing of the brush, limbs and trees have been obtained, and Tandem, Inc., is the low bid; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Tandem, Inc., in an amount not to exceed TWENTY -FIVE THOUSAND AND NO/] 00 DOLLARS ($25,000.00) for the removal and processing of the brush, limbs and trees is hereby authorized. Section 3: That pursuant to the provisions of Texas Local Government Code Annotated § 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTEEN THOUSAND AND NO /100 DOLLARS ($15,000.00) or less, subject to the provision that the original contract price may not be increased by more than twenty -five percent (25 %) or decreased by more than twenty -five percent (25 %) without the consent of the contractor to such decrease. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
