Ordinance No. 8,581990513 -8 ORDINANCE NO. 8581 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING THE CITY OF BAYTOWN PERSONNEL POLICY MANUAL TO PROVIDE FOR THE TRANSFER OF VACATION TIME TO A SERIOUSLY ILL EMPLOYEE; PROVIDING • A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. *********************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Chapter 8 "Absence," Section 2 "Vacation," subsection (1) of the City of Baytown Personnel Policy Manual is hereby amended to read as follows: Chapter 8 ABSENCE Section 2. Vacation 1. The City Manager, upon the request and recommendation of the Department Director, may allow employees to transfer accrued vacation time for a fellow employee to provide paid time off during a "serious health condition" (as defined under the FMLA Policy). The following criteria must be met in order to qualify for this type of transfer: All other leaves accumulated by the seriously ill employee, such as vacation, holiday and compensatory time, have been or are projected to be exhausted prior to any transfer request approval; Authorization through the Human Resources Department for verification of time available; All other requirements under the Family Medical Leave Policy have been completed; Employees may contribute up to one -half of their accrued vacation leave balance; The Department Director has the responsibility to plan and schedule work of the department; therefore, the Department Director must approve all transferred vacation time requests to ensure the safe, efficient operation of the department; and Transfer of vacation time for any one individual shall not exceed 90 (ninety), 8 (eight) hour days. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. 990513 -8a ® Section 3: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance *or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
