Ordinance No. 8,580990513 -7 ORDINANCE NO. 8580 • AN ORDINANCE 'OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING CHAPTER 118 "SIGNS," ARTICLE II "ADMINISTRATION," DIVISION 4 "PERMITS," SECTION 118 -139 "POLITICAL SIGNS" OF THE CODE OF ORDINANCES, CITY OF BAYTOWN, TEXAS; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section l: That Chapter 118 "Signs," Article II "Administration," Division 4 "Permits," Section 118 -139 "Political signs," is hereby amended to read as follows: Sec: 118 -139. Political signs. (a) No permit shall be required under this chapter for a sign erected solely for and relating to a public election for a period commencing 60 days prior to and for ten days following such public election, provided that such unpermitted sign shall be located on private property only, shall be constructed of lightweight material and shall not exceed 50 square feet in size. (b) Any person erecting, maintaining or otherwise placing a political sign not in strict conformity with subsection (a) of this section shall upon conviction be punished as provided in section 118 -3. (c) It is an exception to the enforcement of subsection (b) of this section if a person erects, maintains or otherwise places a political sign in a designated area at least 100 feet from the main entrance to a polling place during a voting period at such polling place. An area may be designated by the city manager when a city facility is used as a polling place or by an official of another governmental entity when such entity's facility is used as a polling place. (d) As used in this section, "voting period" means the period beginning when the polls open for voting and ending when the polls close or the last voter has voted, whichever is later. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed, provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, subsection, paragraph, sentence, ® clause or phrase of this ordinance or the application of same to any person or the set of 990513 -7a circumstances, shall 'for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this-ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
