ORDINANCE N0. 8562
• AN ORDINANCE ACCEPTING THE BID OF EXXON PIPELINE COMPANY IN
THE AMOUNT OF SIX THOUSAND AND NO /100 DOLLARS ($6,000.00) FOR THE
SALE OF THE PORTION OF ST. MARY'S ISLAND OWNED BY THE CITY OF
BAYTOWN, TEXAS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, the City of Baytown, Texas, sought competitive bids for the sale of the portion of St.
Mary's Island owned by the City of Baytown (the "Property), which Property is located in Scott Bay,
Harris County, Texas; and
WHEREAS, an opportunity for open competition was given pursuant to the provisions of Section
73 of the Charter of the City of Baytown; and
WHEREAS, all bids were opened and publicly read at City Hall at 2:00 p.m., Wednesday, March
31, 1999; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby accepts the bid of Exxon
Pipeline Company in the amount of SIX THOUSAND AND NO /100 DOLLARS ($6,000.00) for the
sale of the portion of St. Mary's Island owned by the City of Baytown, which amount is in excess of the
market value of the Property.
Section 2: That the Mayor of the City of Baytown, Texas, is hereby authorized and directed
to execute the Quitclaim Deed for the sale of the aforementioned property. A copy of said Quitclaim
Deed is attached hereto, marked Exhibit "A," and made a part hereof for all intents and purposes.
Section 3: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of
Baytown this the 8`h day of April, 1999.

That the CITY OF BAYTO WN, of Harris County, Texas, GRANTOR, for and in
consideration of the sum of Ten and No /100 Dollars ($10.00) and other good and valuable
consideration paid by the Grantees named below, the receipt and sufficiency of which are
acknowledged by Grantor, has GRANTED, SOLD and CONVEYED, and by these presents does
GRANT, SELL, and CONVEY to EXXON PIPELINE COMPANY, the property described in
Exhibit "A," which is attached hereto and incorporated herein by this reference for all intents and
purposes.
Grantor excludes and excepts any warranties, express or implied, regarding the above -
described property, including, without limitation, any warranties arising by common law or
Section 5.023 of the Property Code or its successor.
TO HAVE AND TO HOLD these premises, together with all and singular the rights and
appurtenances belonging in any way to said property, subject to the provisions stated above, to
Grantees forever, without warranty of any kind.

Being a Parcel of land, a total of 3.081 acres more or less as bounded by the
elevation of the water on September 23, 1998 between the hours of 11:35 A.M. and
12:30 P.M. located between Scott Bay and the Houston Ship Channel out of the
Nathaniel Lynch Survey, Abstract 44 of Harris County, Texas. Said 3.081 acre parcel
now is an island and is a portion of a 372 acre tract of land described in a deed dated
December 15, 1972, form Lewis F. Bonner, Trustee to City of Baytown, Texas,
recorded in County Clerk File D767280, Film Code 155 -21 -0231 and a deed dated
December 15, 1972 from San Jacinto Wharf Company to Mrs. Alice Jane Sheffield,
Trustee, recorded in County Clerk File D765508, File Code 154 -39 -0069 of Official
Public Records of Real Property, Harris County, Texas. Said 3.081 acre tract of land
being more particularly described as follows:
COMMENCING at a found concrete monument with an aluminum cap and known as
'Wimpol' from which the San Jacinto Battlefield Monument bears North 65 °45'43'
West, 12655.68 feet; Monument Tory Hill bears North 39 °49'32" West, 14604.10 feet;
HL &P Co. Water tank bears South 53 °55'07' West; Baytown Water tower bears North
16 °32'45' East; a found concrete monument with an aluminum cap bears North
75 °56'05" East, 55.62 feet; thence South 81 °24'08' East, 203.76 feet to a found
copper weld rod with aluminum cap being at the North corner of a 8.0574 tract of land
