Ordinance No. 8,543990325 -2 ORDINANCE NO. 8543 ® AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING AN UNOPPOSED CANDIDATE ELECTED TO OFFICE; ORDERING THE CITY CLERK OF THE CITY OF BAYTOWN, TEXAS, TO POST THIS ORDINANCE AT EACH POLLING PLACE ON THE ELECTION DAY; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. *********************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** WHEREAS, through Ordinance No. 8499 of the City Council of the City of Baytown, Texas, the City Council called its municipal election to be held on the I" day of May, 1999, for the purpose of electing the following member of the City Council: Councilmember for District No. Two; and WHEREAS, the deadline has now passed for declaring write -in candidacy in such election; and WHEREAS, the City Clerk, the authority responsible for having the official ballot prepared, has certified in writing pursuant to Section 2.052 of the Texas Election Code that the following candidate is unopposed for election to the offices hereinbelow indicated: Scott Sheley Councilmember for District No. Two; and WHEREAS, the City Clerk has delivered the above - referenced certification to the City Council of the City of Baytown, which certification is attached hereto as Exhibit "A" and incorporated herein by this reference for all intents and purposes; and WHEREAS, Sections 2.051, et seq. of the Texas Election Code provide for the cancellation of an election in a particular single- member district by declaring each unopposed candidate elected to office if each candidate whose name is to appear on the ballot is unopposed and no proposition is to appear on the ballot; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Municipal Election ordered by the City Council of the City of Baytown in Ordinance No. 8499, to be held on the I" day of May, 1999, for the purpose of electing the following member of the City Council only: Councilmember for District No. Two will not be held. Section 2: That the City Council of the City of Baytown declares that the following ® candidate is elected to the office opposite his name: Scott Sheley Councilmember for District No. Two DI 990325 -2a Section 3: The City Clerk is hereby directed to post a copy of this ordinance on election day at each of the polling places prescribed in Ordinance No. 8499. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
