The City Council of the City of Baytown, Texas, met in a Regular Meeting on Thursday, July] 1,
2019, at 6:32 P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street,
Baytown, Texas with the following in attendance:

Mayor Pro Tern Hoskins convened the July 11, 2019, City Council Regular Meeting with a
quorum present at 6:32 P.M., all members were present with the exception of Mayor Capetillo
who was absent.
Pledge of Allegiance, Texas Pledge, and Invocation was led by Council Member Alvarado.
1. MINUTES
a. Consider approving the minutes of the City Council Work Session and Regular
Meeting held on April 11, 2019.
A motion was made by Council Member Heather Betancourth and seconded by Council Member
Laura Alvarado approving the April 11, 2019, City Council Work Session and Regular Meeting
minutes. The vote was as follows:

2. RECOGNITIONS AND CITIZEN COMMUNICATIONS
a. Receive recognition from the American Public Works Association (APWA) Texas
Chapter for 2019 Project of the Year for the City of Baytown's San Jacinto Boulevard
Phase I Project.
Director of Public Works/Engineering, Frank Simoneaux presented the agenda item and
introduced Mr. Eric Dardfen, City of Houston Chief Operating Officer of Public Works, who
recognized the City of Baytown's San Jacinto Boulevard Phase I Project, as the 2019 Project of
the Year from the American Public Works Association (APWA) Texas Chapter at the TPWA
Annual Conference in Austin on June 07, 2019.
3. PROPOSED VOLUNTARY ANNEXATION OF APPROXIMATELY 0.47 ACRES
OF LAND, 2402 INTERSTATE 10
a. Conduct the second public hearing regarding the proposed voluntary annexation of
approximately 0.47 acres located along the east bound frontage road of I-10 approximately
2,536 feet east of Thompson Road, addressed as 2402 Interstate /0 Hwy, and legally
described as Tract 2G-2, Block 2, Elena Fruit & Cotton Farms D, Harris County, Texas.
At 6:41 P.M., Mayor Pro Tern Hoskins opened and conducted the second public hearing
regarding the proposed voluntary annexation of approximately 0.47 acres located along the east
bound frontage road of I-10 approximately 2,536 feet east of Thompson Road, addressed as 2402
Interstate 10 Hwy, and legally described as Tract 2G-2, Block 2, Elena Fruit & Cotton Farms
D, Hams County, Texas.

Principal Planning Manager, Chris Chavis presented a summary of the agenda item and stated
that the property owner wanted to bring the property into the City limits to be marketed for
commercial purposes.
Richard Gannon registered to speak at the public hearing regarding agenda item 3.a. to answer
any questions from Council.
At 6:42 P.M., Mayor Pro Tem Hoskins closed the public hearing regarding agenda item 3.a.
b. Consider an ordinance for the first reading of the proposed voluntary annexation of
approximately 0.47 acres located along the east bound frontage road of I-10 approximately
2,536 feet east of Thompson Road, addressed as 2402 Interstate 10 Hwy, and legally
described as Tract 2G-2, Block 2, Elena Fruit & Cotton Farms D, Harris County, Texas.

4. CITY OF BAYTOWN MUNICIPAL ELECTION, NOVEMBER 05, 2019
Mayor Pro Tent Hoskins recommended that agenda items 4.a. and 4.b. be considered together
a. Consider an ordinance calling the City of Baytown Municipal Election to be held on
November 05, 2019, for the purpose of electing three Council Members from Council
District Nos. 1, 2 and 3.
b. Consider an ordinance authorizing the City Manager to negotiate and execute a
Joint Election Agreement with Harris County, Texas, for the Municipal Election to be held
on November 05, 2019.
City Clerk, Leticia Brysch noted that this year would be the first time that a super polling would
be held on election day, whereas, voters would be able to cast their vote at any polling location
across Hams County.
A motion was made by Council Member Laura Alvarado and seconded by Council Member
Heather Betancourth approving Ordinance No. 14,116, regarding agenda item 4.a. and Ordinance
No. 14,117, regarding agenda item 4.b. The vote was as follows:

AND MANNER OF HOLDING SAID ELECTION; PRESCRIBING THE
HOURS; ESTABLISHING THE CENTRAL COUNTING STATION;
PROVIDING FOR AN EARLY VOTING BALLOT BOARD FOR EARLY

ORDINANCE NO. 14,117
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
ENTER INTO A JOINT ELECTION AGREEMENT WITH HARRIS COUNTY
FOR THE MUNICIPAL ELECTION TO BE HELD ON THE 5m DAY OF
NOVEMBER, 2019, UNDER TERMS AND CONDITIONS ACCEPTABLE TO
THE CITY MANAGER AND THE CITY ATTORNEY; AUTHORIZING
PAYMENT THEREFOR IN AN AMOUNT NOT TO EXCEED FIFTY-FIVE
THOUSAND AND NO/100 DOLLARS ($55,000.00); AND PROVIDING FOR
THE EFFECTIVE DATE THEREOF.
5. PROPOSED RESOLUTIONS
a. Consider a resolution authorizing the City Manager to make application to the
United States Department of Housing and Urban Development (HUD) for the 2019-2020
Community Development Block Grant (CDBG) funds and designating an authorized
representative to accept and affirm any grant awarded as a result of the application.
Director of Planning and Community Development, Tiffany Foster presented the agenda and
stated that Resolution No. 2596 authorizes the City Manager to submit an application to the
Department of Housing and Urban Development (HUD) for the 2019-2020 CDBG funds in the
amount of $608,584.00, which is an approximate $80,000 decrease from last year. She noted that
beginning in February 2019; staff solicited funding proposals from local organizations and
received approximately 17 applications. Additionally, she stated a summary of the programs and
recommendations was sent out at the end May and since that time nothing changed.
Council Member Johnson inquired as to what could remedy the yearly dollar amount decrease.
Mrs. Foster stated that locally there was not much that could be done except increasing the
numbers for census. She stated that on the federal level advocacy would be the best approach,
but further noted that this particular program ties into defense and transportation, so as those two
increases, the CDBG funding decrease.
Mr. Woolcry noted that this program was totally eliminated from the President's budget.
Council Member Presley inquired as to why the City did not participate in the federal fording
program called Home Fonds. Mrs. Foster stated that the City of Baytown's population size was
not high enough to get into such home entitlement and noted that those cities that were similar in
population participated in the first home funded pilot program, whereas, now the entities must
have a population of 100,000 or above. Additionally, she noted that the City participated in the
home program at the state level, in which the City of Baytown was currently in a reservation
program to receive funds from homes through the state for housing rehabilitation or construction.

Council Member Betancourth inquired if the sub -standard structure abatement line item was for
a specific project or for unforeseen purposes. In response to Council Member Betantwurth's
inquiry, Mrs. Foster stated that the item in question was for the demolition program to pay for
supplies and administration, but further noted that local city funds paid for the demolition of
structures.

TO THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT FOR THE 2019-2020 COMMUNITY DEVELOPMENT
BLOCK GRANT FUNDS; DESIGNATING AN AUTHORIZED
REPRESENTATIVE; AUTHORIZING THE REPRESENTATIVE TO ACCEPT
OR AFFIRM ANY GRANT AWARD THAT MAY RESULT THEREFROM;
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
6. SPECIAL. DISTRICT BUDGET FISCAL YEAR 2019-20
a. Receive the Fiscal Year 2019-20 Budget of the Baytown Crime Control and
Prevention District ("CCPD").
Director of Finance, Wade Nickerson presented the agenda item and stated that the CCPD board
met on July 09, 2019, and approved its Fiscal Year 2019-20 budget. He stated that the public
hearing for this budget was scheduled for August 08, 2019, and consideration for approval was
scheduled for August 22, 2019.

8. MANAGER'S REPORT
a. The Faith Family Church will hold their annual Serve Day to help beautify and
maintain various City parks and right of ways on Saturday morning, July 13, 2019.
Parks and Recreation Director, Scott Johnson presented the agenda item and stated that The Faith
Family Church scheduled their annual Serve Day to help beautify and maintain various City
parks and right-of-ways on Saturday, July 13, 2019, from 8:00 A.M. to noon.
In conclusion of the manager's report, City Manager Davis recognized Officer Barry Calvert for
receiving his Advanced Peace Officers Certificate and Officer Juan Navarro for receiving his
Masters Peace Officers Certificate.
Additionally, Mayor Pro Tom Hoskins noted that Council received in invitation to the Baytown
PD signalization training.
9. EXECUTIVE SESSION
a. Recess into and conduct an executive session pursuant to Texas Government Code,
Section 551.071 to seek the advice of the City's attomeys regarding pending
litigation involving the City of Baytown.
b. Recess into and conduct an executive session pursuant to Sections 551.071 and
551.087 of the Texas Government Code to deliberate the offer of a financial or other
incentive to a business prospect and to seek the advice of the City's attorneys on legal
matters related thereto.
At 6:54 P.M., Mayor Pro Tern Hoskins recessed into and conducted an executive session
pursuant to Texas Government Code, Section 551.071 to seek the advice of the City's attorneys

regarding pending litigation involving the City of Baytown and Sections 551.071 and 551.087 of
the Texas Government Code to deliberate the offer of a financial or other incentive to a business

At 7:35 P.M., Mayor Pro Tern Hoskins reconvened the Open Meeting of the Regular Meeting
and announced that in accordance with Section 551.102 of the Texas Government Code, no
action was taken in the Executive Session.

With there being no further business to discuss, Mayor Pro Tern Hoskins adjourned the July 11,
