27, 2019, at 6:40 P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street,

Mayor Capetillo convened the June 27, 2019, City Council Regular Meeting with a quorum
present at 6:40 P.M., all members were present with the exception of Council Member Johnson
who was absent.

a. Consider approving the minutes of the City Council Work Session and Regular
Meeting held on March 28, 2019.
A motion was made by Mayor Pm Tem Heather Betancourth and seconded by Council Member
Laura Alvarado approving the June 27, 2019, City Council Regular Meeting minutes. The vote

2. RECOGNITIONS AND CITIZEN COMMUNICATIONS
a. Recognize City of Baytown Employees for their Years of Service.
Director of Human Resources, Carol Flynt presented the agenda item and recognized City of
Baytown employees for their years of service.

3. PROPOSED SPECIAL EVENTS ALCOHOL POLICY
a. Consider an ordinance amending Section 6-2 "Sales near schools, churches,
hospitals or day care facilities" of the Code of Ordinances, Baytown, Texas, to permit
alcoholic beverages for special events held at the Eddie V. Gray Wetlands Education and
Recreation Center and the Wayne Gray Sports Complex.
b. Consider an ordinance amending Section 70-8 "Alcoholic beverages" of the Code of
Ordinances, Baytown, Texas, to permit alcoholic beverages at Town Square, the Baytown
Nature Center, Eddie V. Gray Wetlands Education and Recreation Center, Russell Park,
Wayne Gray Sports Complex, and Evergreen Park
C. Consider a resolution adopting a Special Events Alcohol Policy.
Director of Parks and Recreation, Scott Johnson requested to present agenda items 3.a., 3.b., and
3.c. altogether. He stated that following the work session in May 2019, staff revised the Special
Events Alcohol Policy with input from Council. He stated that the policy was a combination of
the Town Square rental application and the Clubhouse at Evergreen Park Alcohol Policy. He
stated that staff revised the application to Council's specifications of five (5) sites: the Town
Square, the Baytown Nature Center, Umbrella Alley, the Branson Visitor's Information Center
and the Wetlands Center. He stated that staff added the following additional sites for Council's
consideration: Russell Pak (for future use once the park is developed), the Wayne Gray Sports
Complex (provided there are no youth league or tournament games played or scheduled), and
Evergreen Park (to encourage large disc golf toumaments and other activities on the fully
enclosed former golf course). Additionally, he stated that at the request of the Baytown
Historical Museum and the Art League of Baytown, those two (2) sites were also added for
Council's Consideration.

Mr. Scott Johnson stated that the requirements for the Special Events Alcohol Permit included
activities like huge softball games at Sports Complex or Lee High School, a third party event
with a TABC permit license, no BYOB, a minimum of two (2) Baytown police officers or
at least one (1) Baytown officer along with a constable. He stated that all required documents to
include insurance, permitsUicense certificates, and detailed site map of where alwhol would be
served must be complete within 14 days of the event and at the discretion of the Director an
application could be rejected for any reason. Additionally, he stated that the Parks and
Recreation Advisory Board voted unanimously to recommend City Council approval.
Council Member Presley inquired with regards to the Baytown Museum, if a place of worship
should be included in agenda item 3.a., due to the distance requirement to a place of worship.
Mr. Scott Johnson noted that the distance requirement was 300 feet from property line to
property line. City Attorney, Ignacio Ramirez noted that the ACE District was exempted and it
was further clarified that Council Member Presley's inquiry did not need to be added.
Council Member Hoskins recommended that the policy include reference that no alcohol drink
should leave from inside of a facility. Mr. Cliff Hatch noted that such guideline is through the
TABC. Mr. Scott Johnson further noted that the rules for parks did not change and alcohol was
only allowed in the facility during the permit period.
A motion was made by Council Member Chris Presley and seconded by Council Member David
Himsel approving Ordinance No. 14, 101, regarding agenda item 3.a.; Ordinance No. 14,102,
regarding agenda item 3.b.; and Resolution No. 2593, regarding agenda item 3.c. The vote was

4. PROPOSED ORDINANCES
a. Consider an ordinance adopting the Texas Municipal Retirement System (TMRS)
Buyback Policy.
Ms. Flynt presented the agenda item and stated that the buyback policy allows employees the
opportunity to purchase previously forfeited service with TMRS by a one-time lump sum
payment in the amount of the original withdrawal plus a withdrawal charge of five percent (5%)
for each year from the date of the withdrawal. She stated that assuming the immediate purchase
of all this credit, the increase in liability and contribution rate would be $4,145,514 and 0.37%,
during the next actuarial valuation cycle, but further noted that historically, 20% of eligible
members elect to make a purchase. Additionally, she stated that the study indicates there were 68
employees who would become immediately eligible for the repurchase.

a. Consider a resolution renaming Ward Road Park to Missy Davidson Memorial
Park.
Mr. Scott Johnson presented the agenda item and stated that Resolution No. 2594, renames Ward
Road Park located at 1601 Ward Road to Missy Davidson Memorial Park. He stated that Ward
Road Park was the location of Baytown East Little League from the early 60's to 1986 and the
City of Baytown purchased the 14.65 acre tract of land in the year 2004, for youth league
practice fields and was named Ward Road Park by the Parks and Recreation Department. He
stated that the park was never formally named; therefore, Russell "RJ" Davidson submitted an
application to rename the park to Missy Davidson Memorial Park in early April. Mr. Johnson
further stated that the request was discussed at the May 01, 2019, Parks and Recreation Advisory
Board meeting and on June 05, 2019, the Board voted unanimously to recommend the name
change to City Council.
Mr. Scott Johnson stated that Missy Davidson was born in Baytown, worked over 20 years of
service to the City of Baytown as the Human Resources/Civil Service Director, and provided
over 40 years of municipal service to the State of Texas through various organizations. He stated
that she was a positive influence in the Baytown community and spent a considerable amount of
time coaching, managing and volunteering at the former East Little League Park.
Council Member Hoskins recommended that a placard with a picture of Miss Davidson be
installed at the subject park and for this to continue to be done as a memorial for the reason
of naming any park.

RESOLUTION NO.2594
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, NAMING THE WARD ROAD PARK IN MEMORY OF MISSY
DAVIDSON; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
6. DISCUSSIONS
a. Present and discuss the 2019 DirectionFinder citizen survey results.
Mr. Jason Morado, Senior Project Manager with the ETC Institute presented the 2019 citizen
survey results. He stated that ETC specialized in providing community surveys for city and
county governments throughout the country. He stated that the purpose of the subject survey was
to assess how satisfied residents were with City services, help determine priorities for the
community, measure trends from previous surveys, and compare the City's performance with
other communities regionally and nationally. He noted that many of the survey questions
remained the same as those from the previous survey and that the 601 completed surveys were
done via online and by mail. He stated that they checked the demographics to be sure that they
reflected the actual population of the city and that the results results had a 95% level of
confidence with a margin of error of at least +/- 4.0%.
Mr. Morado stated that the main conclusions from the survey included that resident's overall had
a positive perception of the City with 62% being satisfied and 11% being dissatisfied. He
noted that overall satisfaction ratings were similar to previous years; and Baytown rates were
higher than other cities in the overall quality of City services (14% above Texas average and
12% above U.S. average), m well as, in customer service (18% above Texas average and 15%
U.S. average). He further stated that the overall priorities for improvement were traffic
flow/congestion management, maintenance of City streets, and stormwater runoff/flood
prevention. He stated that the overall satisfaction ratings decreased over the years, but remained
higher than the U.S. average.
Mr. Morado stated that the perception of the quality of neighborhood, the appearance of the City,
and residential property significantly increased, but police and wastewater services, along with

drinking water significantly decreased from the year 2018. With regards to maintenance services,
he stated that the adequacy of City street lighting increased, but the major roadways and
sidewalks also decreased from the year 2018. Regarding public safety, he stated that quality local
fire protection and animal control services increased, while local police protection, police
response to emergencies, enforcement of local traffic laws, and efforts to prevent crime
decreased from the year 2018. He stated that satisfaction with parks and recreation special events
sponsored by the City and walking and biking trails increased, but the aquatics facilities and
programs decreased from the year 2018.
Further during the presentation, Mr. Morado stated that in comparison to other cities, the City of
Baytown ranked higher in library services, parks and recreation programs and facilities,
trash/recycling/yard waste services, quality of services provided by the City, but ranked lower
regarding management of stormwater runoff and flood prevention and flow of traffic/congestion
management. He stated with regards to public safety services that local fire protection and efforts
to prevent crime increased, but the quality of animal control services decreased. With regards to
maintenance, he stated that landscaping in the median and mowing/trimming on streets increase,
whereas, street cleanliness and adequate street lighting decreased. He further stated with regards
to public services that residential trash collection and curbside recycling services increased, but
wastewater treatment services decreased. Additionally, he stated that customer service increased
in the areas of being courteous and polite, prompt, accurate, and complete with answers, and
resolving issues.
With regards to overall priorities for improvement, Mr. Morado stated that the flow of
traffic/congestion management was the number one priority followed by the maintenance of
streets, which was followed by the management of stormwater runoff and flood prevention.
Council Member Alvarado requested a map identifying the locations of those who received the
surveys. Mr. Morado stated that he would provide a dot map referencing Council Member
Alvarado's request.
Mayor Capetillo requested for council to consider holding off a year on the survey to allow time
to implement a plan that would address the three (3) main priority improvements.

a. Confirm the City Manager's Appointment of the Director of Engineering of the City
of Baytown.
City Manager Davis presented the agenda item to confirm his appointment of Mr. Frank
Simoneaux as the Director of Engineering of the City of Baytown. He noted that Mr. Simoncaux
was the Public Works Director with a strong engineering background and therefore, highly
recommended him for the position as the Director of Engineering.
A motion was made by Council Member Robert C. Hoskins and seconded by Council Member
Chris Presley approving the appointment of Mr. Frank Simoneaux as the Director of

which was vacated by Mr. Gil Chambers when he resigned in March 2019.
A motion was made by Council Member Robert C. Hoskins and seconded by Council Member
Chris Presley approving the appointment of Mr. Shawn McDonald to the Planning and Zone

Mrs. Brysch presented the agenda item and considered the appointments of Dr. David Corder;
Ms. Kathie Smith; Mr. Gilbert Santana; Mr. Mike Wilson; and Ms. Barbara Wooster to the
Baytown Board of Adjustment. She further stated that the two applications of Mr. Rudy Zepeda
and Mr. Jesse Cano were available for Council's consideration to appoint as an alternate member
of the board.
A motion was made by Council Member Laura Alvarado and seconded by Mayor Pro Tem
Heather Betancourth for the sake of discussion.
A motion was made by Council Member Chris Presley and seconded by Mayor Pro Tem Heather
Betancourth approving the appointments of Dr. David Corder, Ms. Kathie Smith, Mr. Gilbert

a. Present the 3rd and 4th of July Celebration schedule and entertainment lineup for
2019.
Mr. Scott Johnson presented the 3rd and 4th of July Celebration schedule and entertainment
lineup for 2019. He stated that the event would begin at 6:OOP.M, Wednesday, July P,
with New Orleans area band 'Bag of Donuts followed by "The Village People" at 8:OOP.M. He
stated that on Thursday, July 41h at 4:OOP.M., vendor booths would open followed by the Annual
e of July Parade at 5:30P.M. He stated that Baytown native "RL Bell" would kick off the
entertainment at 4:OOP.M. followed by country legend "Joe Diffie" at 6:OOP.M. He further noted
that the traditional July 4" Ceremonies would begin at 7:45P.M., followed by performance from
Country legend "Tracy Byrd" 8:00P.M., and concluded by the Annual Fireworks Extravaganza
at 9:30P.M.
Council Member Alvarado expressed appreciation for the inclusion of a proclamation to the
West Baytown Civic Association for their 30 year anniversary.
