ORDINANCE N0. 8488
AN ORDINANCE ACCEPTING THE BID OF DALE COX IN THE AMOUNT OF
TWELVE THOUSAND AND N01100 DOLLARS ($12,000.00) FOR THE SALE OF
LOTS 21, 22, AND 24; STERLING 10 ACRES; BAYTOWN, HARRIS COUNTY, TEXAS
(ALSO KNOWN AS NORTH MAIN STREET (ROOSTER'S PARKING LOT)); AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the City Council of the City of Baytown, Texas, did authorize the Purchasing
Department of the City of Baytown to advertise for bids for the sale of Lots 21, 22, and 24; Sterling 10
Acres; Baytown, Harris County, Texas (also known as North Main Street {Rooster's parking lot}); and
WHEREAS, notice to bidders as to the time and place, when and where the contract would be let was
published pursuant to the provisions of Section 73 of the Charter of the City of Baytown; and
WHEREAS, all bids were opened and publicly read at City Hall at 2:00 p.m., Thursday, March 28,
1996, as per published notice to bidders; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby accepts the bid of Dale Cox in
the amount of TWELVE THOUSAND AND NO 1100 DOLLARS ($12,000.00) for the sale of Lots 21, 22,
and 24; Sterling 10 Acres; Baytown, Harris County, Texas (also known as North Main Street (Rooster's
parking lot)).
Section 2: That the Mayor of the City of Baytown, Texas, is hereby authorized and directed to
execute the Deed Without Warranty for the sale, of the aforementioned property. A copy of said Deed
Without Warranty is attached hereto, marked "Exhibit "A," and made a part hereof for all intents and
purposes.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of
Baytown this the 14 °i day of January, 1999.

§ KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF HARRIS §
WHEREAS, ad valorem taxes on certain hereinafter described land and premises were the
subject of Cause No. 1,109,482 in the 164th Judicial District Court of Harris County, Texas; and
WHEREAS, a judgment and decree of sale were rendered in the aforesaid cause on
January 15, 1979, in favor of the City of Baytown, Goose Creek Consolidated Independent School
District and Lee College District, and the State of Texas and County of Harris; and
WHEREAS, as a result of a certain execution and order of sale issued on said judgment and
decree of sale, said properties were struck off on the first Tuesday in April, 1979, to the City of
Baytown for the use and benefit of itself and the Goose Creek Consolidated Independent School
District and Lee College District, and the State of Texas and County of Harris; and
WHEREAS, by Deed dated April 25, 1979, and recorded in the deed records of Harris
County, Texas, the hereinafter described land and premises were transferred to the aforesaid
Plaintiffs/Intervenors; and
WHEREAS, pursuant to Section 34.05 of the Property Tax Code of the State of Texas, on
March 28, 1996, the City of Baytown conducted a public sale of the said property at which
DALE COX offered the highest and best bid; and
WHEREAS, the amount bid by DALE COX is less than the market specified in the
judgment of foreclosure or the total amount of the judgment against the property; NOW
THEREFORE
The CITY OF BAYTOWN, TEXAS, a municipal corporation situated in the counties of
Harris and Chambers, State of Texas; GOOSE CREEK CONSOLIDATED INDEPENDENT
SCHOOL DISTRICT AND LEE COLLEGE DISTRICT, situated in the County of Harris, State
of Texas, duly organized and existing under and by virtue of the laws of the State of Texas;
HARRIS COUNTY, a body corporate and politic of the State of Texas, hereinafter sometimes
referred to as GRANTORS, acting by their respective authorized representatives, for and in
consideration of the sum of TWELVE THOUSAND AND N01100 DOLLARS ($12,000.00) to
GRANTORS paid by DALE COX, the receipt of which is hereby acknowledged, have GRANTED,
SOLD, and CONVEYED, said conveyance being made under and by virtue of Section 34.05 of the
Property Tax Code of the State of Texas, and by these presents do GRANT, SELL and CONVEY,
unto DALE COX, all of the following described real property in Harris County, Texas, to -wit:

GRANTORS hereby convey the above described property without warranty and convey to
DALE COX only any right, title or interest that said taxing entities' predecessor in title owned.
GRANTORS convey to DALE COX the property without express or implied warranty, and
all warranties in Texas Property Code are excluded.
TO HAVE AND TO HOLD all the GRANTOR'S right, title and interest in and to the above
described land and premises which were acquired or held by each of the taxing entities under and
by virtue of the aforesaid judgment, execution and order of sale and deed, unto said DALE COX
his successors and assigns forever, so that neither we, nor our successors, nor assigns shall have,
claim or demand any right or title to the aforesaid property, premises or appurtenances or any part
thereof under and by virtue of said judgment, execution and order of sale and deed. This deed shall
be valid and effective only when and if executed by all the GRANTORS, respectively, the City of
Baytown, Texas, Goose Creek Consolidated Independent School District and Lee College District,
and Harris County and State of Texas.
IN TESTIMONY OF WHICH, this deed has been executed as follows:
(i) It has been executed on behalf of the City of Baytown, Texas, on the
day of , 19 , by the Mayor, and attested by its City
Clerk, pursuant to an ordinance of the City Council of the City of Baytown, Texas,
authorizing such execution; and
(ii) It has been executed on behalf of the Goos, Creek Consolidated Indepepde t School
