Ordinance No. 8,313980611 -13 ORDINANCE NO. 8313 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, APPROVING THE SALE BY SEALED BID OF THE PROPERTY KNOWN AS LOTS 21, 22 AND 24, STERLING 10 ACRES, BAYTOWN, HARRIS COUNTY, TEXAS; APPROVING AS AUTHORIZED ALL PREVIOUS ACTIONS TAKEN BY THE CITY OF BAYTOWN CONCERNING THE FORECLOSURE OF THE CITY'S TAX LIEN ON THIS PROPERTY AND THE CONVEYANCE OF THIS PROPERTY TO DALE COX; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Lots 21, 22 and 24, Sterling 10 Acres, Baytown, Harris County, Texas (also known as N. Main Street {in the back of Rooster's parking lot}) was the subject of a delinquent tax lawsuit, being Cause No. 1,109,482; in the 164" Judicial District Court of Harris County, Texas; and WHEREAS, a judgment and decree of sale were rendered in the aforesaid cause on January 15, 1979, in favor of the City of Baytown, Goose Creek Consolidated independent School District and Lee College District, and the State of Texas and County of Harris; and WHEREAS, as a result of a certain order of sale issued on the above judgment and a decree of sale, the above property was struck off on the first Tuesday in April of 1979 to the City of Baytown for the use and benefit of itself and the Goose Creek Consolidated Independent School District and Lee College District, and the State of Texas and County of Harris; and WHEREAS, by deed dated April 25, 1979, and recorded in the deed records of Harris County, Texas, the above - described property was transferred to the City of Baytown, the Goose Creek Consolidated Independent School District and Lee College District, and the State of Texas and County of Harris; and WHEREAS, pursuant to Section 34.05 of the Property Tax Code of the State of Texas, on March 28, 1996, the City of Baytown conducted a public sale of the above - described property at which Dale Cox offered the highest and best bid; and WHEREAS, before the sale of the above - described property to Dale Cox can be consummated by the various governmental entities, it has been determined that the City of Baytown must by Ordinance approve and authorize the foreclosure of its tax lien on the above - described property, and furthermore must confirm and approve the March 28, 1996, public sale by sealed bid; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council hereby confirms, approves and authorizes all actions taken by the City Administration in initiating a lawsuit to collect the delinquent taxes that had ® accrued against Lots 21, 22 and 24, Sterling 10 Acres, Baytown, Harris County, Texas, and the foreclosure of said lien on the above- described property pursuant to the judgment that was obtained in the above- described lawsuit. 1] 980611 -13a Section 2: That the City Council of the City of Baytown hereby further authorizes, approves and confirms that the City Administration's actions in advertising the above - described property for sale by public auction and/or sealed bid, the holding of a sealed bid sale of the above - described property and all other acts taken by the City Administration necessary to conduct a public auction or sale by bid for delinquent tax properties that was held on March 28, 1996. Section 3: That the City Council of the City of Baytown hereby authorizes, approves and confirms that Dale Cox, having submitted the highest and best bid for the property, should be conveyed all of the City's rights and interests in the above- described property, subject to the approval by all the governmental entities with interest in the property of a deed conveying said property. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
