ORDINANCE NO. 8304
® AN ORDINANCE ACCEPTING THE PROPOSAL OF ACOUSTIC TECHNICAL,
INC., FOR THE PURCHASE AND INSTALLATION OF THREE EMERGENCY
OUTDOOR SIREN WARNING UNITS AND AUTHORIZING PAYMENT BY
THE CITY OF BAYTOWN, THE SUM OF SEVENTY -SIX THOUSAND TWO
HUNDRED SIXTY -FOUR AND NO 1100 DOLLARS ($76,264.00);
AUTHORIZING A MEMORANDUM OF UNDERSTANDING; NLkKl iG OTHER
PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.
WHEREAS, the City Council of the City of Baytown did authorize the Purchasing
Department for the City of Baytown to request proposals for the purchase and installation of three
emergency outdoor siren warning units to be received May 27, 1998; and
WHEREAS, notice to proposers as to the time and place, when and where the contract would
be let was published pursuant to the provisions of Section 74 of the Charter of the City of Baytown;
and
WHEREAS, all proposals were opened and publicly read at City Hall at 2:00 p.m.,
Wednesday, May 27, 1998, as per published notice to proposers; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby accepts the proposal of
Acoustic Technical, Inc., for the purchase and installation of three emergency outdoor siren warning
units for the sum of SEVENTY -SIX THOUSAND TWO HUNDRED SIXTY -FOUR AND NO 1100
DOLLARS ($76,264.00), and authorizes payment thereof.
Section 2: That the City Council of the City of Baytown hereby authorizes a
memorandum of understanding with Acoustic Technical, Inc. A copy of said memorandum of
understanding is attached hereto, marked Exhibit "A," and made a part hereof for all intents and
purposes.
Section 3: That pursuant to the provisions of Texas Local Government Code Annotated
§ 252.048, the City Manager is hereby granted general authority to approve any change order
involving a decrease or an increase in costs of FIFTEEN THOUSAND AND NO 1100 DOLLARS
($15,000.00) or less, subject to the provision that the original contract price may not be increased by
more than twenty -five percent (25 %) or decreased by more than twenty -five percent (25 %) without
the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately from and after its passage by the

In response to your call regarding our cost proposal for the above referenced project, ATI
submits the following additional iafonmation:
1. If the city wishes to purchase three: (3) sirens at this time, instead of two (2), ATI will
maintain the unit prices listed on the RFP pricing forth Also, the pricing for ATI's
Computer Monitoring changes (Item 95) will remain at 55,000.00 for three (3) sites.

2. Anticipating that the city is planning to purchase additional sirens in the future to complete
the coverage, AT] will hold these unit prices for a period of two years.
ATI will supply item 45 Computer Monitoring System changes and Engineering Integration
on a man -hour rate of 585.00 per hour and will submit estimates of man - hours required at the
time we are contacted by the city.
3. In regard to local service for your system, ATI has been working with another local
contractor, who is currently installing other ATI systems in your area- Since we are worlang
frequently with them we will work with the city to set up a program of annual mainicnance
and emergency response through the local contractor and our factory technicians.
