Ordinance No. 8,289Published in the Baytown Sun: 980528 -4 Tues, June 2, 1998 and Wed, June 3, 1998 ORDINANCE NO. 8289„ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING THE CODE OF ORDINANCES, BAYTOWN, TEXAS, CHAPTER 86 "SOLID WASTE," ARTICLE II "RESIDENTIAL SOLID WASTE," DIVISION l "GENERALLY," SECTION 86 -31 "COMPLIANCE REQUIRED" AND DIVISION 2 "COLLECTION," SECTION 86 -70 "YARD WASTE" AND SECTION 86- 71 "BRUSH "; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. ******************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Chapter 86 "Solid Waste," Article II "Residential Solid Waste," Division I "Generally," Section 86 -31 "Compliance Required" of the Code of Ordinances, City of Baytown, Texas, is hereby amended by adding subsection (c), which subsection reads as follows: ARTICLE H. RESIDENTIAL SOLID WASTE DIVISION 1. GENERALLY Sec.86 -31 Compliance required. (c) Solid waste services described in this article are provided in return for payment as outlined in division 3 of this article. Section 2: That Chapter 86 "Solid Waste," Article it "Residential Solid Waste," Division 2 "Collection," Section 86 -70 "Yard waste" of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows: ARTICLE II. RESIDENTIAL SOLID WASTE DIVISION 2. COLLECTION Sec. 86 -70. Yard waste. The collection of yard waste shall be made one time per week on a regularly scheduled basis. Section 3: That Chapter 86 "Solid Waste," Article II "Residential Solid Waste," Division 2 "Collection," Section 86 -71 "Brush" of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows: • 980528 -4a ARTICLE II. RESIDENTIAL SOLID WASTE DIVISION 2. COLLECTION See. 86-71. Brush. (a) The collection of brush shall be made one time per month on a scheduled basis. (b) Brush collected by the city shall not exceed ten cubic yards of clean material per residential unit each month. Material in excess of this limit shall be the responsibility of the resident for proper hauling and disposal. Section 4: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 5: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or the set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 6: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
