Ordinance No. 8,273980514 -6 ORDINANCE NO. 8273 ® AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF TWO HUNDRED FORTY - EIGHT THOUSAND FOUR HUNDRED TWENTY AND NO /100 DOLLARS ($248,420.00) TO MARTIN APPARATUS AND EQUIPMENT FOR THE PURCHASE OF FIRE APPARATUS; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the procurement of the fire truck is necessary (i) to preserve and protect the public health and safety of the citizens of the City of Baytown; (ii) to replace two reserve trucks which have sustained unforeseen damages; and (iii) to preserve the property within the City of Baytown. WHEREAS, Texas Local Government Code Annotated § 252.022, provides that in case of procurements for the protection of public health, safety or property, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for a fire truck have been obtained, and Martin Apparatus and Equipment, is the low bid; NOW THEREFORE - BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists and declares that that the procurement of the fire apparatus is necessary (i) to preserve and protect the. public health and safety of the citizens of the City of Baytown; (ii) to replace two reserve trucks which have sustained unforeseen damages; and (iii) to preserve the property within the City of Baytown. Section 2: That payment to Martin Apparatus and Equipment of the sum of TWO HUNDRED FORTY -EIGHT THOUSAND FOUR HUNDRED TWENTY AND NO /100 DOLLARS ($248,420.00) is hereby authorized for the purchase of the Pierce Manufacturing 1,250 GPM, triple combination pumper, stock number EB534, modified to the satisfaction of the City of Baytown and certified to meet NFPA Standard 1901, 1996 edition. Section 3: That pursuant to the provisions of Texas Local Government Code Annotated § 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTEEN THOUSAND AND N01100 DOLLARS ($15,000.00) or less, subject to the provision that the original contract price may not be increased by more than twenty-five percent (25 %) or decreased by more than twenty -five percent (25 %) without the consent of the contractor to such decrease. ® Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. 980514 -6a INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of Baytown this the 14' day of May, 1998. /ql& C. dzl-A-� PETE C.
