ORDINANCE NO. 8237
® AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, DECLARING UNOPPOSED CANDIDATES ELECTED TO OFFICE;
ORDERING THE CITY CLERK OF THE CITY OF BAYTOWN, TEXAS, TO
POST THIS ORDINANCE AT EACH POLLING PLACE ON THE ELECTION
DAY; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, through Ordinance No. 8178 of the City Council of the City of Baytown, Texas,
the City Council called its municipal election to be held on the 2 "d day of May, 1998, for the purpose
of electing the following members of the City Council:
Mayor
Council Member for District Four;
Council Member for District Five; and
Council Member for District Six; and
WHEREAS, the deadline has now passed for declaring write -in candidacy in such election;
and
WHEREAS, the City Clerk, the authority responsible for having the official ballot prepared,
has certified in writing pursuant to Section 2.052 of the Texas Election Code that the following
candidates are unopposed for election to the offices hereinbelow indicated:
Pete C. Alfaro Mayor
E. Frank Hinds, Jr. Council Member for District Number Four
David Byford Council Member for District Number Five; and
WHEREAS, the City Clerk has delivered the above - referenced certification to the City
Council of the City of Baytown, which certification is attached hereto as Exhibit "A" and
incorporated herein by this reference for all intents and purposes; and
WHEREAS, Sections-2.051, et seq. of the Texas Election Code provide for the cancellation
of an election in a particular single- member district by declaring each unopposed candidate elected
to office if each candidate whose name is to appear on the ballot is unopposed and no proposition
is to appear on the ballot; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the Municipal Election ordered by the City Council of the City of Baytown
in Ordinance No. 8178, to be held on the 2 " day of May, 1998, for the purpose of electing the
following members of the City Council only:
® Mayor,
Council Member for District Four, and
980326 -1a
40 Council Member for District Five
will not be held.
Section 2: That the City Council of the City of Baytown declares that each of the following
candidates are elected to the offices opposite their respective names:
Pete C. Alfaro Mayor
E. Frank Hinds, Jr. Council Member for District Number 4
David Byford Council Member for District Number 5; and
Section 3: The City Clerk is hereby directed to post a copy of this ordinance on election
day at each of the polling places prescribed in Ordinance No. 8178.
Section 4: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City
of Baytown on this the 26 "' day of March, 1998.

• the election scheduled for May 2, 1998, has been ordered for the purpose
of electing members to the governing body of the City of Baytown from
single- member districts;
• only one candidate's name is to be placed on the ballot for each of the
above - listed offices;
• no candidate's name is to be placed on a list of write -in candidates for any
of the above - listed offices under applicable law; and
• no proposition is to appear on the ballot.
