Ordinance No. 8,215Published in The Baytown Sun 980226 -9 Tuesday, March 3, 1998, and Wednesday, March 4, 1998 Ordinance No. 8215 ® AN ORDINANCE OF THE CITY OF BAYTOWN ADOPTING AND ENACTING A NEW CODE OF ORDINANCES FOR THE CITY OF BAYTOWN, TEXAS; PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN; PROVIDING FOR A PENALTY NOT EXCEEDING TWO THOUSAND AND NO /100 DOLLARS ($2,000.00) FOR THE VIOLATION OF ANY FIRE, SAFETY, ZONING OR PUBLIC HEALTH OR SANITATION PROVISION OF THE CODE AND NOT EXCEEDING FIVE HUNDRED AND NO 1100 DOLLARS ($500.00) FOR THE VIOLATION OF ANY OTHER PROVISION OF THE CODE UNLESS SPECIFICALLY STATED OTHERWISE, WHICH PENALTIES SHALL APPLY TO ALL AMENDATORY ORDINANCES TO THE CODE TO DATE; PROVIDING FOR THE MANNER OF AMENDING SUCH CODE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: The Code entitled "Code of Ordinances, City of Baytown, Texas," published by Municipal Code Corporation consisting of chapters 1 through 30, each inclusive, is adopted. Section 2: All ordinances of a general and permanent nature enacted on or before October 23, 1997, and not included in the Code or recognized and continued in force by reference therein, are repealed. Section 3: The repeal provided for in Section 2 hereof shall not be construed to revive any ordinance or part thereof that has been repealed by subsequent ordinance that is repealed by this ordinance. Section 4. Unless another penalty is expressly provided, every person convicted of a violation of any provision of the Code or any ordinance, rule or regulation adopted or issued in pursuance thereof that governs or regulates fire, safety, zoning or public health or sanitation, including dumping of refuse, shall be punished by a fine not exceeding $2,000. The violation of any other provision of this Code or any other ordinance, rules, regulation or order shall be punished by a fine not exceeding $500.00 unless specifically states otherwise in the Code. Each act of violation and each day upon which any such violation shall occur shall constitute a separate offense. The penalty provided by this section, unless another penalty is expressly provided, shall apply to the amendment of any Code section, whether or not such penalty is reenacted in the amendatory ordinance. In addition to the penalty prescribed above, the city may pursue other remedies such as abatement of nuisances, injunctive relief, administrative adjudication and revocation of licenses or permits. n 980226 -9a Section S: Ordinances adopted after October 23, 1997, and prior to the adoption of this ordinance, that amend or refer to the ordinances that have been codified in the Code are subject to the same penalty as prescribed in Section 4 hereof. Section 6: Additions or amendments to the Code when passed in the form as to indicate the intention of the City to make the same a part of the Code shall be deemed to be incorporated in the Code, so that reference to the Code includes the additions and amendments. Section 7: Ordinances adopted after October 23, 1997, that amend or refer to the ordinances that have been codified in the Code shall be construed as if they amend or refer to like provisions of the Code. Section 8: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after passage of this ordinance.
