ORDINANCE NO. 8196
® AN ORDINANCE TERMINATING THE LEASE AGREEMENT WITH RIGHT
DIRECTION COMMUNITY ACTION CENTER CONCERNING THE
PROPERTY DESCRIBED AS LOTS 13 2, 3, 21, 22, 23, AND 24, BLOCK 28,
GOOSE CREEK SUBDIVISION (A/KIA PRUETT), BAYTOWN, HARRIS
COUNTY, TEXAS; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF. IV
WHEREAS, the property described as Lots 1, 2, 3, 21, 22, 23, and 24, Block 28, Goose
Creek Subdivision (a/k/a Pruett), Baytown, Harris County, Texas (the "Property ") was struck off
to the City of Baytown (the "City ") for the benefit of Goose Creek Consolidated Independent
School District (the "School ") in a tax foreclosure sale; and
WHEREAS, the City and the School, seeing a need for youth programs dealing with anti -
gang activities, decided to lease the Property to a non - profit organization that would agree to run
such a program; and
WHEREAS, on April 29, 1996, the Property was leased to Right Direction Community
Action Center (the "Center ") for the operation of an anti -gang, violence prevention community
resource center; and
WHEREAS, to date, the Center has failed to provide or otherwise conduct any anti -gang
activities on the Property; and
WHEREAS, to date, the Center has yet to provide the proper insurance pursuant to the
terms of the lease agreement; and
WHEREAS, the Center has been notified in writing of such lease violations on several
occasions but have yet to remedy its breach of the lease agreement; and
WHEREAS, a letter expressing the City's intent to terminate the lease agreement was
sent to the Center through its attorney Anthony P. Griffin, on January 8, 1998; and
WHEREAS, the City Council of the City of Baytown desires to terminate the lease
agreement pursuant to the terms of the lease agreement for any one of the above - referenced
violations; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: All matters and facts set forth in the recitals above are found to be true and
are approved as the findings of the City Council of the City of Baytown.

• Section-2: That the City Council of the City of Baytown, Texas, hereby exercises it
option and privilege to terminate the lease agreement' between the City of Baytown and Right
Direction Community Action Center dated the 291h day of April, 1996, concerning the real
property located at 407 West Pearce, Baytown, Texas, more particularly described as Lots 1, 2,
3, 21, 22, 23, and 24, Block 28, Goose Creek Subdivision (a/k/a Pruett), Baytown, Harris
County, Texas.
Section 3: That the City Council of the City of Baytown authorizes the refund of
prepaid rent in the amount of THIRTY -EIGHT AND 21 /100 DOLLARS ($38.21) to Right
Direction Community Action Center.
Section 4: This ordinance shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the
City of Baytown this the 12'h day of February, 1998.
