ORDINANCE NO. 8188
AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING
® THE PAYMENT OF THE SUM OF FORTY -FIVE THOUSAND FIVE HUNDRED TEN AND
NO/ 100 DOLLARS ($45,510.00) TO ALLCO, INC., FOR REPAIR OF THE M.ABRY STREET
SANITARY SEWER LINE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, a section of sewer line on Mabry Street has collapsed resulting in the need to immediately repair
the same in order to protect the health, safety and welfare of the citizens of Baytown; and
WHEREAS, Section 252.022 of the Texas Local Government Code provides that in case of unforeseen
damage to public machinery, equipment or other property, the requirement for competitive bids is not applicable; and
WHEREAS, informal bids for repair of the Mabry Street sanitary sewer line have been obtained, and AI ico,
Inc., is the low bid; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency
situation exists.
Section 2: That payment to Allco, Inc., of the sum of FORTY -FIVE THOUSAND FIVE HUNDRED
TEN AND NO /100 DOLLARS ($45,510.00) for repair of the Mabry Street sanitary sewer line is hereby authorized.
Section 3: That pursuant to the provisions of Section 252.048 of the Texas Local Government Code, the
City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in
costs of FIFTEEN THOUSAND AND NO /100 DOLLARS ($15,000.00) or less, subject to the provision that the
original contract price may not be increased by more than twenty-five percent (25 %) or decreased by more than
twenty-five percent (25 %) without the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately from and after its passage by the City Council
of the City of Baytown.
