ORDINANCE NO. 8171
® AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS;
DIRECTING THE DIRECTOR OF UTILITIES TO OBTAIN INFORMAL BIDS
FOR THE REPAIR OF THE SANITARY SEWER LINE AND OTHER RELATED
APPURTENANCES IN THE VICINITY OF 1008 EAST BAKER ROAD;
AUTHORIZING THE PAYMENT OF A SUM NOT TO EXCEED ONE
HUNDRED THOUSAND AND NO /100 DOLLARS ($100,000.00) TO THE
LOWEST RESPONSIBLE BIDDER FOR SUCH REPAIRS; AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, a sanitary sewer line in the vicinity of 1008 East Baker Road has failed causing
damage to related appurtenances and resulting in the need to immediately repair the same in order
to protect the health, safety and welfare of the citizens of Baytown; and
WHEREAS, Section 252.022 of the Texas Local Government Code provides that in case of
unforeseen damage to public machinery, equipment, or other property, the requirement for
competitive bids is not applicable; and
WHEREAS, informal bids for the repair of the sanitary sewer line and related appurtenances
in the vicinity of 1008 East Baker Road are currently being obtained by the Director of Utilities of
the City of Baytown; however, the lowest responsible bidder has not been determined at the time of
the passage of this ordinance; and
WHEREAS, the City Council desires that the necessary repairs at a competitive price be
made as soon as possible; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an
emergency situation exists.
Section 2: That the Director of Utilities of the City of Baytown is authorized and
directed to obtain informal bids in order to ascertain the lowest responsible bidder to whom the work
for the necessary repairs is hereby awarded.
Section 3: That payment to the lowest responsible bidder, as determined by the City
Manager through the informal bidding process conducted by the Director of Utilities, of up to ONE
HUNDRED THOUSAND AND NO1100 DOLLARS ($100,000.00) for the repair of the sanitary
sewer line and related appurtenances in the vicinity of 1008 East Baker Road is hereby authorized.
Section 4: That pursuant to the provisions of Section 252.048 of the Texas Local
Government Code, the City Manager is hereby granted general authority to approve any change
isorder involving a decrease or an increase in costs of FIFTEEN THOUSAND AND NO /100
DOLLARS ($15,000.00) or less, subject to the provision that the original contract price may not be

increased by more than twenty -five percent (25 %) or decreased by more than twenty -five percent
(25 %) without the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City
of Baytown this the 13" day of January, 1998.
