• AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ON
PORTIONS OF STATE HIGHWAY 146 WITHIN THE CORPORATE LIMITS,
OF THE CITY OF BAYTOWN; AUTHORIZING AND DIRECTING THE
PLACEMENT OF SIGNS BY THE TEXAS DEPARTMENT OF
TRANSPORTATION PROJECT DIRECTOR; REPEALING ORDINANCES
INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE;
PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND
NO /100 DOLLARS ($200.00); AND PROVIDING FOR THE PUBLICATION
AND EFFECTIVE DATE THEREOF.

WHEREAS, the Texas Department of Transportation has made it known to the City of
Baytown that it desires to alter the prima facie speed limits along portions of State Highway 146
within the corporate limits of the City of Baytown; and
WH= EREAS, pursuant to Section 545.356 of the Texas Transportation Code, authorizing
alteration of maximum prima facie speed limits with respect to highways or portions thereof
within the corporate limits of the City of Baytown based upon engineering and traffic
investigations and requested public hearings; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the following prima facie speed limits hereafter indicated are
determined and declared to be reasonable and safe and such speed limits are hereby fixed at a rate
of speed indicated for vehicles traveling upon the named highways, or parts thereof, described as
follows:
• Along State Highway 146 main lanes from Cedar Bayou to 528 feet south of
Alexander Drive, a distance of approximately 2.097 miles, 55 miles per hour.
• Along State Highway 146 west and east frontage road from Ferry Road to
1,558 feet north of Ferry Road, a distance of approximately 0.295 miles, 35
miles per hour.
• Along State Highway 146 west frontage road from 1,108 feet north of
Alexander Drive to J. B. LeFevre (formerly Lynchburg Road), a distance of
approximately 4.120 miles, 50 miles per hour.
• Along State Highway 146 west frontage road from 845 feet north of West
Main Street to the south city limits of Baytown, a distance of approximately
1.429 miles, 50 miles per hour.
• Along State Highway 146 east frontage road from 1,108 feet north of
Alexander Drive to J. B. LeFevre (formerly Lynchburg Road), a distance of
approximately 4,120 miles, 45 miles per hour.

Main Street to the south city limits of Baytown, a distance of approximately
1.429 miles, 40 miles per hour.
Section 2: That necessary signs for posting the speed zones will be furnished,
installed and maintained by the direction of the Texas Department of Transportation engineer in
charge of the project.
Section 3: All ordinances or parts of ordinances inconsistent with the terms of this
ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of
such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter covered by this ordinance.
Section 4: If any provisions, section, exception, subsection, paragraph, sentence,
clause or phrase of this ordinance or the application of same to any person or set of
circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall
not affect the validity of the remaining provisions of this ordinance or their application to other
persons or sets of circumstances and to this end all provisions of this ordinance are declared to be
severable.
Section 5: That any person violating the provisions of this ordinance shall, upon
conviction, be fined in any sum not to exceed TWO HUNDRED AND NO /] 00 DOLLARS
($200.00).
Section 6: This ordinance shall take effect from and after ten (10) days from its
passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing
the caption of this ordinance to be published in the official newspaper of the City of Baytown at
least twice within ten (10) days after passage of this ordinance.
