Ordinance No. 8,083970925 -4 ORDINANCE NO. 8083 ® AN ORDINANCE AUTHORIZING THE PAYMENT OF THE SUM OF SEVENTY -NINE THOUSAND AND NO 1100 DOLLARS ($79,000.00) TO ACOUSTIC TECHNOLOGY, INC., AS THE SOLE SOURCE FOR THE ADDITION OF TWO SIRENS AS WELL AS THE COMPUTER HARDWARE AND SOFTWARE UPGRADES TO THE COMMUNITY WARNING SYSTEM; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the Community Warning System (the "System ") currently includes fifteen sirens (15) with four (4) controllers and has a limited coverage area; and WHEREAS, the City of Baytown desires not only to expand the coverage area by adding two (2) additional sirens to the System but also to enhance the existing system by upgrading computer hardware and software from a DOS environment to Windows 95 environment; and WHEREAS, the upgrade of the existing hardware and software of the System will require upgrades to the controllers of the City as well as Exxon, Chevron and Bayer and reconfiguration at each siren site; and WHEREAS, Texas Local Government Code Annotated § 252.022 provides that when the functional requirements of the City can only be satisfied by one source, the requirement for competitive bids is not applicable; and WHEREAS, the procurement of the sirens and the computer hardware and software can be satisfied by only one source, Acoustic Technology, Inc.; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that only one source can satisfy the needs of the City for the addition of two sirens as well as the computer hardware and software upgrades to the Community Warning System. Section 2: That payment to Acoustic Technology, Inc., as the sole source, of SEVENTY - NINE THOUSAND AND NO /100 DOLLARS ($79,000.00), for the above - described sirens and computer hardware and software upgrades is hereby authorized. Section 3: That pursuant to the provisions of Texas Local Government Code Annotated § 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTEEN THOUSAND AND NO /100 DOLLARS ($15,000.00) or less, subject to the provision that the original contract price may not be increased • 970925 -4a ® by more than twenty -five (25 %) or decreased by more than twenty -five (25 %) percent without the consent of the contractor to such decrease. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
