ORDINANCE NO. 8080
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN ADDING AN
.8957 ACRE TRACT AT GARTH ROAD AND CEDAR BAYOU- LYNCHBURG ROAD TO
COUNCIL DISTRICT NO. 4; REPEALING ORDINANCES INCONSISTENT HEREWITH;
CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND
EFFECTIVE DATE THEREOF.
WHEREAS, Section 17(1) of the Charter of the City of Baytown provides that the City Council shall
redistrict the City if the growth of the City justifies; and
WHEREAS, it is necessary to include the newly annexed territory described herein in a Council District;
NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: Council District No. 4 is hereby redistricted by the addition of certain property which is
described on the attached Exhibit "A."
Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are
hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter
covered by this ordinance.
Section 3: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of
this ordinance or the application of same to any person or set of circumstances, shall for any reason be held
unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this
ordinance or their application to other persons or sets of circumstances and to this end all provisions of this
ordinance are declared to be severable.
Section 4: This ordinance shall take effect from and after ten (10) days from its passage by the City
Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be
published in the official newspaper of the City of Baytown at least twice within ten (10) days after passage of this
ordinance.

A 0.91 17 acre tract of land (called 0.8957 acre tract of land) out of Block 140, of Elena Fruit &
Cotton Farms, Unit "D", Harris County, Texas as surveyed on the ground December 6, 1996,
under the supervision ofLec E. Horace6cld, Jr. R.P.L.S. No. 1921, being all of that certain 0.8957
acre tract of land conveyed to Benjamin W. Mason and Florence L. Mason, by Joseph Pucci and
Irene T Pucci by deed recorded under Clerk's File No. G189273 of the Rcal Property Records of
Harris County, Texas, and being more particularly described by metes and bounds as follows:
Beoring reference is the north righr -0f- -way line of Cedar Bayou - Lynchburg Road. North 77 015'30" A'est.
BEGR, N4'ING at a 112 inch iron rod in found in the cast line of said 0.8957 acre tract of land being
in the north right -of -way Line of Cedar Bayou - Lynchburg Road (100 foot wide to the east) found
marking the southwest corner of 1.6207 acre tract ofland conveyed to the Hensuling Group,
L.P., by M. S. Young Company, Inc., Monte S. Young and wife, Alma Dec Hanson Young and
Carl C. Young and wife, Rheba Nell Young by deed recorded under Clerk's File No. S 123053 of
the Official Public Records of Real Property of Harris County, Texas, said point being the
northwest corner of a 0.0772 acre tract of land conveyed to Hams County for widening of Cedar
Bayou - Lynchburg Road by deed recorded under Clerk's File No. M486732 and'the northeast
corner of a 0.1478 acre tract of (and conveyed to the County of Ham's as a perpetual easement by
Judgement recorded under Clerk's File No. M836814 of the Olacial Public Records of Real
Property of Harris County, Tcxas;
THENCE South 09 °4730" East (called South 09 °53'00" East), a distance of 36.35 feet to a point
for the southeast corner of said 0.8957 acre tract of land being in the north right -of -way line of
Cedar -Bayou Lynchburg Road (70 foot wide) and the southeast corner of said 0.1478 acre tract of
land;
THENCE North 77 015'30" West (called North 772'21'00" West), with tht north right- of-way line of
said Cedar -Bayou Lynchburg Road, (70 foot wide), the south line of said 0.8957 acre tract of land
and the south line of said 0.1478 acre tract of land a distance of 191.93 feet (called 191.53 feet) to
a point for the southwest corner of said 0.8957 acre tract of land, the southwest comer of said
0.1478 acre tract of land and the southeast corner of a tract or parcel of land conveyed to Paul
