ORDINANCE NO. 8044
AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR THE PUBLIC
® HEARINGS ON THE PROPOSED ANNEXATION OF A THIRTEEN (13) ACRE
TRACT NORTH OF BAKER ROAD AT EMMETT 0. HUTTO BOULEVARD;
DIRECTING THE PREPARATION OF A SERVICE PLAN; AUTHORIZING AND
DIRECTING THE CITY CLERK TO PUBLISH NOTICE OF SUCH PUBLIC
HEARINGS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section l: On the I Ith day of September, 1997, at 6:35 o'clock p.m. and at 6:45 o'clock p.m.,
in the John Tucker Hall of Lee College, 200 Lee Drive, Baytown, Texas, the City Council will hold public
hearings giving all interested parties the right to appear and be heard on the proposed annexation by the
City of Baytown, Texas, of the property described in Exhibit "A," which is attached hereto and made a part
hereof for all intents and purposes.
Section 2: In compliance with Texas Local Government Code Annotated § 43.056, as
amended, the Planning Department is hereby directed to prepare a service plan that provides for the
extension of municipal service into the area described in Exhibit "A."
Section 3: The City Clerk of the City of Baytown is hereby authorized and directed to cause
notice of each public hearing to be published once in the newspaper having general circulation in the City
and in the above described territory not more than twenty (20) days nor less than ten (10) days prior to the
date of each public hearing, all in accordance with Texas Local Government Code Annotated § 43.052.
Section 4: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of
Baytown this the 281h day of August, 1997.

FIELD NOTES of a 13.000 acre tract of land situated in the Harvey
Whiting Survey, Abstract Number 840, Harris County, and being out
of and a part of a 101.24 .acre tract of land conveyed to Theo and
L. D. Wilburn by Majorie Williams McCullough, et ux, by deed
dated April 20, 1994, and recorded in Volume 1377 at Page 376 of
the Deed Records of Harris County, Texas. This 13.000 acre tract
of land is more particularly described by metes and bounds as

BEGINNING corner a 3/4 inch iron rod found for the Northwest
corner of said Emmett Hutto,to Harris County tract and the
Northwest corner of Emmett Hutto Boulevard, 44 foot right of way,
bears South 82' 041 2611 West a distance of*714.101, and the
Southwest corner of the Houston Lighting and Power Company 150
foot right -of -way in the North right -of -way line of Baker Road
bears South 89° 521 34" East a distance of 830.35 feet.
THENCE North 89° 521 3411 West with the South line of this tract
of land,-the South line of said 103.24 acres, and the North .
right -of -way line of Baker Road a distance of 435.00-feet,to a
1/2. inch iron rod set for the Southwest corner of this tract of
land; and the point of curvature of a curve to the right concave
Northeast .
THENCE in a Northerly direction with the West line of this tract
and said curve to the right, concave Northeast, having a central
angle of 90. 00' 0011, a radius of 25.00 feet, a length of 39.27
feet and a chord bearing and distance of North 44' 521 34" West

West line of this tract of land, and the point of tangency of
