AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR THE PUBLIC HEARINGS ON
THE PROPOSED ANNEXATION OF AN .8957 ACRE TRACT OF LAND AT GARTH ROAD
AND CEDAR BAYOU- LYNCHBURG ROAD; DIRECTING THE PREPARATION OF A
SERVICE PLAN; AUTHORIZING AND DIRECTING THE CITY CLERK TO PUBLISH
NOTICE OF SUCH PUBLIC HEARINGS; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: On the 1 0th day of July, 1997, at 6:35 o'clock p.m. and at 6:45 o'clock p.m., in the John
Tucker Hall of Lee College, 200 Lee Drive, the City Council will hold public hearings giving all interested parties
the right to appear and be heard on the proposed annexation by the City of Baytown, Texas, of the property
described in Exhibit "A" which is attached hereto and made a part hereof for all intents and purposes.
Section 2: In compliance with Texas Local Government Code Annotated § 43.056, as amended, the
Planning Department is hereby directed to prepare a service plan that provides for the extension of municipal
service into the area described in Exhibit "A."
Section 3: The City Clerk of the City of Baytown is hereby authorized and directed to cause notice
of each public hearing to be published once in the newspaper having general circulation in the City and in the above
described territory not more than twenty (20) days nor less than ten (10) days prior to the date of each public
hearing, all in accordance with Texas Local Government Code Annotated § 43.052.
Section 4: This ordinance shall take effect immediately from and after its passage by the City Council
of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of Baytown

Cotton Farms, Unit "D ", Harris County, Texas as surveyed on the ground December 6, 1996,
under the supervision of Lcc E. Horace6eld, Jr. R-P.L.S. No. 1921, -being all of that certain 0.8957
acre tract of land conveyed to Benjamin W. Mason and Florence L. Mason, by Joseph Pucci and

Hams County, Texas, and being more particularly described by metes and bounds as follows:

in the north right -of way line of Cedar Bayou - Lynchburg Road (100 foot wide to the east) found
marking the southwest corner of a 1.6207 acre tract ofland conveyed to the Hensarling Group,
L.P., by M. S. Young Company, Inc., Monte S. Young and wife, Alma Dee Hanson Young and
Carl C. Young and wife, Rheba Nell Young by deed recorded under Clerk's File No. S123053 of
the Official Public Records of Real Property of Hams County, Texas, said point being the
northwest corner of a 0.0772 acre tract of land conveyed to Hams County for widening of Cedar
Bayou - Lynchburg Road by deed recorded under Clerk's File No. M486732 and'the northeast
corner of a 0.1478 acre tract of land conveyed to the County of Harris as a perpetual casement by
Judgement recorded under Clerk's File No. M836814 of the Official Public Records of Real
Property of Hares County, Tcxas;
THENCE South 09 °47'30" East (called South 09 °53'00" East), a distance of 36.35 feet to a point
for the southeast comer of said 0.8957 acre tract of land being in the north right -of -way line of
Cedar -Bayou Lynchburg Road (70 foot wide) and the southeast corner of said 0. 1478, acre tract of
